Especially because it appears likely that FCC is going to rule that they don't have a lot of regulatory power over broadband (apparently in a bid to prevent future administration from restoring net neutrality. I've heard California is working on this. The FCC will try to block this, of course, but I'm pretty sure states' rights is the aspect that's going to be challenged aggressively in court.
