FCC's position on state preemption will likely end up in court.  Especially because it appears likely that FCC is going to rule that they don't have a lot of regulatory power over broadband (apparently in a bid to prevent future administration from restoring net neutrality.  

 

Congress used to hold hearings and settle these kinds of issues with legislation.  Used to.  :(

I have a hard time convincing myself that this isn't just another heavy handed way to throttle dissent via the interwebs. Yeah, we'll let you run wild overcharging people for Netflix, but you're gonna have to stifle some of that snark coming down about Melanoma's shoes and Donny's little hands.

Is it true that certain states are putting safeguards in to keep ISPs from gouging customers too hard? I've heard California is working on this.

 

The FCC will try to block this, of course, but I'm pretty sure states' rights is the aspect that's going to be challenged aggressively in court.
