The Supreme Court, and abortion.

Supreme Court allows lawsuit challenging Texas abortion ban to continue but keeps law in effect for now

KEY POINTS
  • The Supreme Court ruled that a lawsuit challenging the constitutionality of the new Texas abortion ban can proceed before the law is enforced against anyone.
  • But the Supreme Court allowed the Texas law, known as S.B. 8, to remain in effect during that challenge.
  • The decision came after justices heard arguments in a separate case on a Mississippi law that threatens the constitutional right to abortion enshrined in the Roe v. Wade ruling.

Interesting. Justice Kavanaugh actually raised the prospect of this during oral arguments. They cracked open the door and Newsome  just busted right through it.

Gun manufacturers and dealers have broad liability protection under federal law and would trump state law.  But if CA really wanted to they could create all kind of wonky laws to try to accomplish what they want.  Create right to sue any business transacting with gun manufacturers and dealers. I'm talking suppliers, banks, landlords, utility companies,  lawyers, accountants, whatever.  States could go really crazy down this rabbit hole to accomplish what they want. Which is precisely why this private enforcement scheme should've been laughed out of court to begin with.

I get the larger picture thing… but not real excited to go down this path of doing business this way…

It might be the only way to get people to wake up to this Republican crap legislation in the states. As a 70 year old woman in Texas, the abortion ban doesn't apply to me, but it does apply to other Texan girls and women who want an abortion and want bodily autonomy. Frankly, I'm sick of the Republican Death Cult.

I read the actual SCOTUS opinion and it felt like a punt.  Roberts basically indicated the scheme is unconstitutional.  The conservative seemed to act like they needed a real controversy.

If they allow this scheme to stand and CA goes forward with action to restrict gun rights, and the SCOTUS doesn't allow it, it will further erode SCOTUS legitimacy.

Not like we aren't dealing with the entire legitimacy of our political system at this point.  What with a ruling party that hasn't one the popular vote, two ruling parties own by corporations, corporations getting stronger....

Pro life indeed.

Violence From Self-Proclaimed 'Pro-Lifers' Increased 125% Last Year

Between 2019 and 2020, despite the COVID-19 pandemic, abortion providers across the country reported an increase in “vandalism, assault and battery, death threats/threats of harm, stalking, and hoax devices/suspicious packages,” according to a new report by the National Abortion Federation.

Most alarmingly, providers reported a 125% increase in assaults and altercations instigated by anti-abortion protesters, including “shoving, pushing, tripping, and spitting on clinic escorts, staff, and others outside of clinics.” NAF’s report calls these incidents “particularly disturbing,” considering the ongoing public health concerns around COVID-19.

The report also highlights that between 2019 and 2020, death threats and threats of harm to clinic staff more than doubled, from 92 to 200. Clinics reported 27 cases of receiving suspicious packages last year, up from just two in 2019, as well as double the cases of stalking clinic staff. There were also four reported cases of arson in 2020 compared with none the year before, and internet harassment against providers increased by about 10%.

An unusual new provision, introduced by state Rep. Mary Elizabeth Coleman (R), would allow private citizens to sue anyone who helps a Missouri resident obtain an abortion out of state, using the novel legal strategy behind the restrictive law in Texas that since September has banned abortions in that state after six weeks of pregnancy.

So now it's time to pass a law that prohibits truckers leaving their own states to protest?

We need laws allowing out of state providers to sue, in federal court, any state that unfairly inhibits their ability to do business.  And to sue any individual that sues their patients.

because really is there a more American solution than more lawsuits?
