‘No documentary evidence’ supports Trump’s claim it is ‘impossible’ to secure bond for $464 million civil fraud penalty: NY Attorney General

Prosecutors working under New York Attorney General Letitia Jameson Wednesday urged a court to reject Donald Trump‘s claims that he cannot find a private insurer to guarantee the staggering $464 million bond he must pay after he was found liable for civil fraud in the Empire State.

Trump made that argument, as Law&Crime previously reported, in a gargantuan filing on Monday to the Supreme Court of the State of New York Appellate Division, saying the amount plus interest made it a “practical impossibility” to obtain.

The very few companies who may be willing to insure the bond would only do so with cash as collateral, not real estate, he argued.

But senior assistant solicitor general Dennis Fan contends that’s not remotely the case and that despite Trump’s filing spanning nearly 5,000 pages, the “defendants supply no documentary evidence that demonstrates precisely what real property they offered to sureties, on what terms that property was offered, or precisely why the sureties were unwilling to accept the assets.”

Fan’s letter continued: “As far as the Court can infer, sureties may have refused to accept defendants’ specific holdings as collateral because using Mr. Trump’s real estate will generally need “a property appraisal’ … and his holdings are not nearly as valuable as defendants claim.”

Trump begs MAGA supporters for help as $464M fraud bond deadline approaches: ‘Keep your filthy hands off Trump Tower!’

Former President Donald Trump issued a frantic plea for financial support to MAGA voters Wednesday as his deadline to pay his $454 million bond in the New York civil fraud case looms.

“KEEP YOUR FILTHY HANDS OFF OF TRUMP TOWER!,” reads a message to Trump’s supporters from a joint fundraising committee that allocates the money to his campaign and a separate political committee that has been paying his legal bills.

The civil fraud case brought by New York state Attorney General Letitia James in 2022 is one of several legal battles Trump faces ahead of the upcoming presidential election.

The message urged supporters to donate in amounts ranging from $20.24 to $3,300 or more.

The grift is strong with this one.  At $20 per donation he'd need 23 million donations, even if he averaged donations of $100, he'd need 4.6 million donations.  Good luck with that.

Just saying.

If the people who actually have the money, thought that he would be POTUS a year from now?  They'd be chipping in.

If they thought he was going to win his appeal(s)?  They'd be chipping in.

He needs to pay by Monday.  I'm still not convinced he won't manage to come up with a bond by then.  Just as he whined about paying the E. Jean Carroll verdict and asking for a stay, and then coming up with the bond anyway.

Everything I've read says that if he doesn't come up with a bond or the cash that Letitia James is ready to start seizing assets immediately.

Til ANYTHING happens to him, i am convinced nothing will.
Nothing ever DOES. He ignores orders, ignores rulings, ignores verdicts, does whatever the **** he wants, and nothing stands in his way even a LITTLE bit.

Letitia James takes first step to seize Trump's Seven Springs resort and N.Y. golf course

New York Attorney General Letitia James is already making preparations to seize former President Donald Trump's properties in New York's Westchester County as the Monday deadline for him to post bond in the civil fraud judgment draws near.

According to Bloomberg News, "New York state’s $454 million judgment against Donald Trump in a civil fraud lawsuit was formally registered in Westchester County just outside Manhattan, a sign that his properties in the area may be at risk of being seized if the former president fails to post an appeal bond."

The report states, while the filing didn't specify a reason for the registration, it is the first step to allow James to secure property liens — and there are two valuable Trump properties in the affluent Westchester County: Trump National Golf Club Westchester, and his Seven Springs estate, a 212-acre resort complex that is partially undeveloped.

New York Attorney General takes initial step to prepare to seize Trump assets

The New York attorney general’s office has filed judgments in Westchester County, the first indication that the state is preparing to try to seize Donald Trump’s golf course and private estate north of Manhattan, known as Seven Springs.

State lawyers entered the judgments with the clerk’s office in Westchester County on March 6, just one week after Judge Arthur Engoron made official his $464 million decision against Trump, his sons Donald Trump Jr. and Eric Trump, and the Trump Organization.

Entering a judgment would be the first step a creditor would take to attempt to recover property. Additional steps, such as putting liens on assets or moving to foreclose on properties, or taking other actions in court would follow, if the asset is going to be seized.

The judgment is already entered in New York city where Trump’s properties including Trump Tower, his penthouse at Trump Tower, 40 Wall Street, his hotel abutting Central Park, and numerous apartment buildings are located.

Judgments have not been entered in Florida counties including Miami or Palm Beach where Trump’s Mar-a-Lago property and the Trump National Doral Golf Club and resort are located or Cook County, Illinois, where Trump’s hotel in Chicago is located, according to a review of records Thursday by CNN.

The process to seize assets would not be quick or easy. Trump has structured his business by setting up limited liability companies for nearly every property or asset – over 300 in total – which ultimately are controlled by his trust.

“They are complexly organized and he is not on paper the owner and therefore a judgment against him would not be executable directly against certain properties. Sorting this out is not going to be simple and it’s not going to be quick,” said Nikos Passas, a professor of criminology and criminal justice at Northeastern University.

“In the meantime, she could also obtain bank levies and go after the bank assets. She could put liens on properties. There are all kinds of things that she’s able to do in an effort to collect,” Passas said.

Judge gives monitor expansive duties including review of efforts to obtain bond

Thursday, Engoron expanded the role of the monitor overseeing the Trump Organization to include more expansive oversight of Trump’s real estate business’ internal financial practices.

Engoron also ordered the Trump Organization to supply detailed information to the monitor about its efforts to obtain bonds to cover judgments.

Could Monday be the end of the  Trump campaign?

The deadline to pay the bond is Monday. Leticia James could start siezing  his assets on Monday.

He could have a complete psychotic and mental breakdown on Monday and no longer be able to function and have to be committed.

Let’s pray 🙏 this happens.

The maga propaganda machine runs like  clockwork and it’s great when you know how to read it.

case in point - the “let them have it” would appear to me to be getting out in front of the fact that it’ll be seized. Which means they know it’ll be seized. Which is fantastic news.

'The dumbest thing he could have done': Ex-prosecutor laughs at Trump's new cash boast

Donald Trump's Truth Social rant Friday in which he claimed to be sitting on $500 million in cash was met by a mixture of skepticism and mirth on CNN, with co-hosts and legal experts suggesting he likely doesn't have the money — and if he does it just opened up a whole new can of worms for him.

In an early all-cap post, the former president boasted: "THROUGH HARD WORK, TALENT, AND LUCK, I CURRENTLY HAVE ALMOST FIVE HUNDRED MILLION DOLLARS IN CASH, A SUBSTANTIAL AMOUNT OF WHICH I INTENDED TO USE IN MY CAMPAIGN FOR PRESIDENT."

...

With CNN co-host John Berman asserting, "If you're the appeals court, who's got to decide whether to reduce the money or not, wouldn't you look at this post on Truth Social saying, 'Wait a second, you just told me you have the money you were saying it's impossible [to find]. Why should we give you any grace here, if you're saying you've got it?"
