Judge orders Capitol riot defendant remain jailed after lashing out over 'Foxitis' assertion

 

A judge on Friday ordered a US Capitol riot defendant to remain jailed in part because of a previous incident in which the defendant became so incensed by the suggestion that a person who took part in the January 6 attack had "Foxitis" that he allegedly threatened a probation officer.

 

The defendant, Landon Copeland, will be held in jail until he faces trial, federal magistrate Judge Robin Meriweather decided Friday. Prosecutors say that on January 6, Copeland stole a riot shield, turned a metal fence into a weapon and shoved other rioters into the police line. He hasn't yet entered a plea to the four charges in that case.

 

Most of the more than 600 Capitol riot defendants are not being held in jail as they await trial. However, a few rioters have had their release conditions revoked because judges believe they pose a threat, including a former police officer who bought 37 guns after his arrest, and a New York man who called his probation officer's mother.

 

Prosecutors say that Copeland had been released for just two days following his arrest in May when he stormed into a probation office in Utah.

 

Copeland disrupted a virtual court hearing for multiple defendants by lashing out over another defendant's lawyer saying his client had "Foxitis" from watching right-wing media outlets. Court officials muted Copeland's phone line.

 

That's when Copeland called a probation officer and announced he was on his way because he wanted to be heard and would "die for it," according to the officer who testified during the more than two-hour hearing Friday.

Jan. 6 suspect known as ‘zip-tie guy’ violates bond conditions

 

A man with Georgia roots arrested for storming the U.S. Capitol as part of a mob of Trump supporters has violated the terms of his bond, prosecutors said.

 

Prosecutors asked U.S. District Court Judge Royce C. Lamberth to place 30-year-old Eric Gavelek Munchel under the supervision of his older brother after he was tossed out of a Nashville apartment where he had been sleeping on a sofa for several months.

 

In a motion Thursday filed in federal court in Washington, D.C., prosecutors also asked that Munchel, a bartender, be prohibited from consuming alcohol, noting that his “behavior” contributed to his eviction.

 

“Should the Defendant again fail to comply with conditions of release while under the supervision of his new third party custodian, the United States will move to revoke his pretrial release,” prosecutors wrote.

 

Munchel’s attorney did not respond to an email seeking comment.

 

Munchel is charged with 11 criminal counts related to the Jan. 6 Capitol riot.

US Capitol Police announces six disciplinary cases against officers from Jan. 6 insurrection

 

The United States Capitol Police (USCP) announced that disciplinary action has been recommended in six cases against officers following internal investigations into the January 6 attack on the US Capitol.

 

Violations sustained include three cases for conduct unbecoming, one for failure to comply with directives, one for improper remarks, and one for improper dissemination of information, according to a USCP statement released Saturday. The statement did not specify if the six cases involved six separate officers nor did it name any of them. CNN has reached out to the USCP for clarification.


"The six sustained cases should not diminish the heroic efforts of the United States Capitol Police officers. On January 6, the bravery and courage exhibited by the vast majority of our employees was inspiring," the release said.


The USCP's Office of Professional Responsibility launched 38 internal investigations, and was able to identify the officers involved in 26 of those cases. In 20 of the cases, no wrongdoing was found, according to the statement.


A seventh case regarding an official who is accused of unsatisfactory performance and conduct unbecoming is still pending.

Trump’s White House chief of staff is target of Capitol attack records request

 

The House select committee investigating the 6 January attack on the Capitol has instructed telecom and social media companies in recent weeks to preserve records of Donald Trump’s White House chief of staff, Mark Meadows, according to a source familiar with the matter.

 

The move positions the select committee on the doorstep of the Oval Office as it pursues a far-reaching inquiry into whether Trump and his White House helped plan or had advance knowledge of the insurrection perpetrated by the former president’s supporters.

 

House select committee investigators signaled their intention to examine potential involvement by the Trump White House and House Republicans when they made a series of records demands and records preservation requests for Trump officials connected to the Capitol attack.

 

In the records preservation requests, the select committee instructed 35 telecom and social media companies to avoid destroying communications logs of several hundred people, including the House minority leader, Kevin McCarthy, and 10 House Republicans, in case it later issues subpoenas.

 

But the previously unreported inclusion of Meadows on the list of people whose records the select committee wants preserved suggests the panel will seek more information on the most senior aide in the Trump administration and could upturn every inch of the West Wing in its inquiry.

Woodward/Costa book: Worried Trump could 'go rogue,' Milley took top-secret action to protect nuclear weapons

 

Two days after the January 6 attack on the US Capitol, President Donald Trump's top military adviser, Joint Chiefs Chairman Gen. Mark Milley, single-handedly took top-secret action to limit Trump from potentially ordering a dangerous military strike or launching nuclear weapons, according to "Peril," a new book by legendary journalist Bob Woodward and veteran Washington Post reporter Robert Costa.

 

Woodward and Costa write that Milley, deeply shaken by the assault, 'was certain that Trump had gone into a serious mental decline in the aftermath of the election, with Trump now all but manic, screaming at officials and constructing his own alternate reality about endless election conspiracies.'


Milley worried that Trump could 'go rogue,' the authors write.


"You never know what a president's trigger point is," Milley told his senior staff, according to the book.


In response, Milley took extraordinary action, and called a secret meeting in his Pentagon office on January 8 to review the process for military action, including launching nuclear weapons. Speaking to senior military officials in charge of the National Military Command Center, the Pentagon's war room, Milley instructed them not to take orders from anyone unless he was involved.


"No matter what you are told, you do the procedure. You do the process. And I'm part of that procedure," Milley told the officers, according to the book. He then went around the room, looked each officer in the eye, and asked them to verbally confirm they understood.


"Got it?" Milley asked, according to the book.


"Yes, sir."


'Milley considered it an oath,' the authors write.

DC Police Will Be ‘All Hands on Deck' for Saturday's Protest at US Capitol

 

Law enforcement agencies in Washington, D.C., plan to have a large presence at Saturday's rally at the U.S. Capitol as threats of armed protesters spread online.

 

The Justice for J6 rally is planned for Saturday outside the Capitol. That rally is in support of the rioters who violently stormed the building on Jan. 6.

 

"As we look across social media, there are calls on some of the disparate sites for folks to come armed. We’ve seen that before on a lot of our other events. So, this is reminding folks that come to the District what our laws are here and that, you know, you can't carry a gun here," DC Deputy Mayor for Public Safety Chris Geldart told News4.

 

Geldart said while the mayor has not requested the National Guard, the U.S. Capitol Police still could.

September 18 Rally Will Prohibit Pro-Trump Clothing

 

The former Trump campaign staffer who is organizing Saturday’s “Justice for J6” rally in support of people who were charged with crimes related to the Capitol riot has asked attendees not to wear any clothing in support of former President Trump or President Biden.

 

Matt Braynard, the event organizer, wrote in a tweet on Tuesday that attendees should not display any symbols that are supportive of Trump or Biden as the rally is “100% about #JusticeforJ6 and not the election or any candidate.”

 

“Anyone not honoring this request will be assumed to be an infiltrator and we will take your picture, find out who you are, and make you famous,” he added.

Alabama Sen. Tommy Tuberville said he won’t attend an upcoming Capitol rally that is expected to bring as many as 700 people to Washington, D.C. on Saturday, Sept. 18.

 

The rally, organized by Look Ahead America, is being held to support rioters jailed for their participation in the deadly Jan. 6 Capitol riots, Roll Call reported. Capitol Police Chief J. Thomas Manger is set to brief Congressional leaders today on the rally as an intelligence assessment from Sept. 7 notes an uptick in violent rhetoric online.

 

Nine members of Congress have been invited to attend. Seven – including Tuberville – said they will not attend. Others invited include Sens. Ted Cruz of Texas and Mike Lee of Utah and Reps. Louie Gohmert of Texas, Lauren Boebert of Colorado and Madison Cawthorn of North Carolina and Paul Goas of Arizona.

 

Two invitees, Republican Reps. Marjorie Taylor Greene of Georgia and Matt Gaetz of Florida, have not confirmed their plans.
