The Administration said it would not be a tax as they would not "Tax" anyone below 250k, even argued in court its not a tax? (and now its a tax). Despite all the rumors that some portion of the law will likely be thrown out, I think the entire law will be upheld by both Kennedy and Roberts, making it 6-3 to leave the law as it stands. Trying to judge how the court will sway based on the line of questioning is often misleading, and I think it will prove to be so in this case. You win! Good call. The Dems retake the House and keep the Senate. Liberalism on steroids in 2013. Or does this lead to the opposite, Romney cruises to victory, Repubs keep the House and take the Senate. The funny thing about this is that the Health Care mandate doesn't set a precedent, laws congress passes don't do that. But a supreme court ruling does however. So it's kind of ironic that the argument made against that health care law that the government would start making us buy broccoli (lol) is ultimately what may open the door for just that. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. My gut says that this will give Obama his victory. i can see how it might make liberals a little more enthusiastic about obama's first term, but i don't see why anyone already opposed to obama would move in his favor (or vice versa). i predict little practical impact, and obama will retain his current slight electoral advantage.
