Pence came within a hair's breadth of complying with Trump's wishes on J6.

No he didn't.

He was against Trump's plan since the first time Trump suggested the plan to him. The one thing he did NOT do, is go public with the plan. Which I think he should have. He knew they lost, he knew he was on his way out in about a month or so. But he wanted to keep his stature in the GOP...so he did put his interests over the interests of the country by remaining mum. Trump had numerous people talk to Pence to convince him the plan was legal and legit, and Pence had his team start researching what he was being told. So, no, he didn't come within a hair's breadth of complying.

You are correct.  However, the fact that he didn't come forward when he knew other people were engaged in illegal activities is itself a crime.  It's called Misprision of a Felony. 18 U.S. Code § 4

Quote

Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.

Is the "commission of a felony" part a loophole since they had not committed the felony yet? Or for that law, is knowing of the planning to commit a felony the same as knowing a felony has been committed?

Well some of the false elector schemes were done before Jan. 6th so there were many crimes before that day.  I'm pretty sure he was made aware of Eastman's plan.

Just observing - "planning to commit a felony" is called "conspiracy".  And it's a felony.

Have to say, I really don't care about finding documents at Pence's place.

He doesn't have a history of intentionally trying to destroy records.

Or of taking intentional steps to conceal them.

And my (admittedly ignorance-based) opinion of him is that he didn't intentionally steal them, with intent to sell them.

Rather, my opinion is that he's like almost everybody at that level. He spent years, handling maybe hundreds of classified documents a day. And occasionally, he (or somebody under him) made a mistake.

I don't think it's news.
