Alabama’s permitless carry law stirs questions, concerns among law enforcement, gun rights group

 

Two law enforcement leaders in South Alabama, and the head of BamaCarry are all calling on state lawmakers to make changes to Alabama’s new permitless carry law that went into effect on New Year’s Day.

 

Mobile County Sheriff Paul Burch and Mobile Police Chief Paul Prine, during a joint news conference Wednesday, said the new law was “ambiguous,” confusing to lawyers and includes “varying degrees of punishment.”

 

They also said it includes odd language. One example, cited by Prine, is a provision instructing a motorist, after getting pulled over by a law enforcement officer, not to “touch a handgun” with his or her fingers.

 

“It’s odd that they would put that into the law, that specific language,” said Prine. “For most of us, it’s common sense for someone not to touch their weapon when encountering a law enforcement official. But someone felt it should be part of the law and make it part of the violations.”

 

Someone who touches their gun during a traffic stop could be subject to a Class A misdemeanor. That is a different level of punishment than other classes of misdemeanor violations contained within the same law, Prine and Burch said.

 

Prine said that law enforcement also remained concerned over whether firearms were allowed at or near schools, and he urged lawmakers to be more clear given the backdrop of mass shootings at schools nationwide.

 

“I would be an advocate of not allowing firearms on school property,” he said. “The fact we’re having this discussion today simply tells you there is a lot that is misunderstood (about the new law) and there is no clarity.”

 

Gun rights advocates also share concerns with the new law, even if they have different viewpoints from law enforcement.

Crazy B Boebert done stepped in it again.  Said she didn't know "who was on the other side" of the shaking doors on the House floor on 1/6 and that she should have been armed. 

I assume she means she would have shot the people who were doing what she wanted them to do, disrupt the certification of the vote.

Federal agents discovered a dumpster filled with almost 250 working rifles and shotguns in Oklahoma, and allege that a man was given 2 free shotguns to hang on his wall

 

Federal agents are trying to figure out why an Oklahoma gun store owner threw almost 250 guns in a dumpster, and why a man was allegedly allowed to keep two of them as a memento.

 

According to court filings first reported by Cour****ch, on January 19, 2023, an Oklahoma City, Oklahoma, sanitation worker stumbled upon a dumpster with 236 rifles and 12 shotguns in it. The shocking finding led him to call authorities, who found many of the guns were functional, the filings stated.

Investigators wrote that in late 2022, the owner of the store, International Firearm Corporation, Anthony Mussatto, had asked agents with the Bureau of Alcohol, Tobacco, and Firearms how to destroy the weapons, citing a manufacturer's defect.

 

Mussatto was told in the fall by the ATF to slice the faulty guns in three different areas, according to a January 26 search warrant. 

 

Several months later, on same day the agency was contacted by the sanitation worker, ATF agents visited the dumpster and found functional guns, "despite being partially cut," according to the warrant.

 

The agents then encountered two men near the store who told them that they had seen the dumpster loaded with guns on separate occasions, months before the January incident.

 

Mike Keenum, one of the men near the store, told agents that a teen employee had been cutting the weapons outside of the store multiple days a week, when he approached the employee and said he was interested in owning the guns.

 

"Mr. Keenum told the man that he did not intend to shoot the guns, but rather wanted to hang the firearms on his wall," an ATF agent said in the warrant. "The male employee permitted Mr. Keenum to take two uncut firearms and gave Mr. Keenum two magazines, one for each firearm."

Ban on marijuana users owning guns is unconstitutional, U.S. judge rules

 

A federal law prohibiting marijuana users from possessing firearms is unconstitutional, a federal judge in Oklahoma has concluded, citing last year's U.S. Supreme Court ruling that significantly expanded gun rights.

 

U.S. District Judge Patrick Wyrick, an appointee of former Republican President Donald Trump in Oklahoma City, on Friday dismissed an indictment against a man charged in August with violating that ban, saying it infringed his right to bear arms under the U.S. Constitution's Second Amendment.

 

Wyrick said that while the government can protect the public from dangerous people possessing guns, it could not argue Jared Harrison's "mere status as a user of marijuana justifies stripping him of his fundamental right to possess a firearm."

Grants to help Alabama sheriffs make up for lost pistol permit fees

 

Each of Alabama’s 67 county sheriffs is about to start getting payments from a grant based on the amount of money each department collected on pistol permit fees in 2022, according to an announcement made Monday by Gov. Kay Ivey.

 

Pistol permits have historically made up a significant portion of sheriff’s office funding in Alabama. On Jan. 1, however, a new state law went into effect that allows for anyone 18 or older, who is not prohibited by state or federal law, to carry a concealed pistol without a permit.

 

Montgomery County Sheriff Derrick Cunningham said in December that he was looking at a 60% funding loss on permits, which previously generated more than a half-million dollars in the county budget.

Oregon Supreme Court upholds order blocking new voter-approved gun laws

 

The Oregon Supreme Court has denied a petition to overturn a lower court ruling blocking the state’s new gun laws from taking effect. Ballot Measure 114′s provisions remain blocked in their entirety pending a lower court hearing on the measure’s constitutionality.

 

“We recognize that the legal status of Measure 114 is of significant concern to many Oregonians,” the justices wrote in their order. “Of course, it is the role of the judicial branch of government to resolve disputes such as challenges to laws enacted by the legislative branch, which includes the people exercising their initiative power.”

 

But the justices concluded it is not appropriate for them to become involved when the dispute is still being addressed through the trial court.

 

It is the second time the state Supreme Court has declined to get involved in the proceedings.
