Judge Mulls How to Punish Sheriff Joe Arpaio for Racially Profiling Latinos

 

PHOENIX -- A federal judge delayed a decision to refer Maricopa County Sheriff Joe Arpaio for criminal contempt charges, but hinted that hundreds of Latinos who were detained by his deputies solely on suspicion that they were in the country illegally could soon be compensated.

 

U.S. District Court Judge Murray Snow on Tuesday heard arguments over what penalties Arpaio and his office should face for continuing to racially profile Latinos during traffic stops and immigration patrols after court orders barred him from doing so.

 

Snow had ruled on May 13 that the sheriff and three of his top aides were in civil contempt for violating court orders.

 

The judge said racial profiling victims could receive up to $1,000 in restitution for the first hour they were detained, and an additional $200 for every 20 minutes they were detained.

 

Judge Snow also said he was considering appointing someone to oversee full oversight of internal affairs at the sheriff's office.

 

"I don't have confidence anymore about the direction of the Maricopa County sheriff's office," Snow said.

 

During Tuesday's civil contempt hearing, Snow also considered a number of penalties for Arpaio and his deputies. He said Arpaio was "the most culpable" for violating the court orders to stop racial profiling. But he said his abilities to impose penalties on Arpaio were limited because this was a civil contempt proceeding and because the sheriff is an elected official.

Lawyers representing the plaintiffs urged Snow to refer the case to the U.S. Attorney's Office for criminal contempt charges, which could lead to fines and jail time for the sheriff.

This is not even remotely the worst thing he has done in his career. He is one of the most vile pieces of **** holding any kind of power in this country. 

 

It is disheartening to see that his popularity is high enough that Republicans have to kiss his ass every election cycle.

Arizona Sheriff Joe Arpaio formally charged with criminal contempt

According to the Arizona Republic, Sheriff Joe Arpaio has been formally charged with criminal contempt.

U.S. District Judge Susan Bolton signed a proposed order initially submitted by prosecutors Oct. 17, charging the controversial sheriff with federal contempt of court, setting his trial for Dec. 6 in U.S. District Court in Phoenix.

Well, we already know he illegally profiled, was ordered by a federal court to stop doing it, continued to do it, and lied to the court about it.   All of that has been established by the federal court already.

The only question now is whether his actions rose to the level of a  federal crime.  If not, they remain disgraceful and dishonest and warrant the civil contempt sanctions that already have been assessed (and perhaps a temporary federal takeover of the Maricopa County Sheriff's Office).   

There is no scenario under which he is "innocent" in the sense that this crap didn't happen.   It happened.  The only question is whether it was a crime.  It's very hard to criminally convict an elected official for acts taken in his or her official capacity (for good reason).

Racially profiling Latinos is just one part of the systematic targeting, intimidation, and abuse of Hispanics this crazy sheriff has made his official policy.  US immigration is a giant mess without this jerk using it as an excuse to bully Hispanics.  It's disturbing that he's been getting away with it this long and I have no faith that the system will ever hold him personally responsible.

Joe Arpaio’s lawyer just quit for ‘ethical’ reasons weeks before sheriff’s criminal contempt trial

 

Mere weeks prior to former Maricopa County Sheriff Joe Arpaio’s trial in which he’s charged with criminal contempt, his lead defense attorney has quit.

AZCentral reports that Mel McDonald filed a brief with the court that a request is being made in “good cause” and under ethical rules, his resignation from the case is “mandatory.”

 

The notorious sheriff could earn six months in jail for refusing to follow a judge’s order in a case Arpaio lost three years ago. Arpaio was accused of resisting a 2011 court order to cease his immigration patrols in Phoenix. At the time, he swore he didn’t violate the order intentionally, but the court was able to prove he did.

If the lawyer is withdrawing for ethical reasons, I gonna guess he didn't want to be charged with suborning perjury. That means he knows that his client has or is going to commit perjury. 

 

There could be other reasons but he's not going to put himself at risk of prosecution or censure.

Actually, I think he'd be much better off being put among the folks he's put there. Let him truly be "just" a civilian now, among other civilians who are sure to remember him.
