Fergasun
I didnt read the 55 pages... but the argument is that by reducing the penalty to 0 is the same as collapsing Obamacare? If Congress wanted to do that, they would have killed Obamacare. Activist judge much?

PleaseBlitz
This comes one month after Dems won 40 seats in the House where their best issue was protecting healthcare. Would be great politically if this is still working through the 5th Circuit and then SCOTUS in 2020.

AsburySkinsFan
Big surprise! Tbe Republicans are once again wasting everyone’s time, money and efforts with a ruling that will be over-turned on appeal all so they can show their dumbass voters that they are trying to fulfill campaign promises. Trump’s been getting his ass kicked for weeks, the GOPers needed the appearance of a win which is why Ohio just passed a heartbeat abortion law that WILL be struck down. I’m so sick of these ****s and their supporters who enable them.

88Comrade2000
My marketplace rates went down for the first time. Let this thing play out in 2020.  Trump and the GOP taking away healthcare and probably during a recession too. That will do wonders at the ballot box. TheGreatBuzz
This definitely wreaks of judicial activism. But let's not pretend that is only an issue the the Right. Judicial branch needs an overhaul.   As does the other two branches. Larry
Admiring how quickly the GOP will pivot from yelling that the entire law is unconstitutional, because it contains an individual mandate, to yelling that it's unconstitutional because it doesn't (even though it does).
Fergasun
I can't believe the headlines... this is against the core ACA ruling from the Supreme Court. Honest judges look at legislative intent. Congress just reduced the penalty to zero. They didn't wipe out the law. That can only be done by a vote in the Senate and House and bill signed by the President. I just read the core of the opinion. If ACA gets "hacked out" by these GOP activist judges (I forgot that Kennedy's seat flipped) there will be some political hell to pay by the GOP. How can it be that reducing the tax to zero invalidates the law? The GOP legislsture never had the political votes for repeal so they are using their own activist judges to repeal?!?!? Larry
Actually, near as I can tell, the judge didn't rule that the ACA is unconstitutional. He ruled that the GOP's attempt to sabotage the ACA is unconstitutional.
PleaseBlitz
Reminder: This is a ruling from one (1) district court. It likely has to go through 2 more levels to have any impact.

bearrock
It's a joke of a ruling. But GOP can easily save ACA even under the judge's ridiculous reasoning by instituting a 1 cent penalty tax for the individual mandate. Go ahead GOP. Ensure protection for preexisting conditions like you've been promising during the midterms.

This ruling, rather, is that the Republicans successfully turned Obamacare into something unconstitutional.
