Judge Allows MMA Fighter to Testify at Trial About Derek Chauvin’s Use of a ‘Blood Choke’ Hold on George Floyd

 

Prosecutors in the murder trial of Derek Chauvin scored an evidence victory Wednesday morning which could have broad repercussions for the case against the former police officer accused of killing George Floyd on May 25, 2020.

 

Chauvin’s defense attorney, Eric Nelson, asked Judge Peter Cahill via a Feb. 8 motion in limine to prevent Donald Williams, a college wrestler and trained MMA fighter who just happened to be a witness to the May 25th events, from testifying “as to his training, experience and/or expertise in mixed martial arts, boxing or other training on the grounds that it is irrelevant and overly prejudicial.”

 

Judge Cahill ruled that Williams would be able to testify mostly as the state requested.

Federal look into Breonna Taylor's death casts a wider net

 

Their numbers have dwindled since protesters first flooded Louisville’s streets after police fatally shot Breonna Taylor in her home a year ago, but their push for justice has never waned.

A federal investigation of the shooting that has been quietly proceeding could be their last chance.

 

“We can’t expect people to continue to emotionally and mentally keep moving forward when there hasn’t been any justice yet for Breonna Taylor,” said Rep. Attica Scott, a state lawmaker who was tear-gassed and arrested during summer protests in the city. “We’ve been failed every single time from every level of government, and we need a freaking break.”

 

That could come in the form of the ongoing inquiry by the U.S. Department of Justice, which appears to have expanded well beyond the actions of the three police officers who fired their guns into Taylor's home on March 13, 2020. Last year, a grand jury formed by state Attorney General Daniel Cameron charged one officer with putting Taylor's neighbors in danger but issued no charges related to her death.

 

The warrant that sent the police to Taylor’s home was not part of Cameron's criminal investigation, but that document and how it was obtained are under review by federal investigators. And there are signs the investigation could range into the Louisville police response to protests after the shooting.

Judge rules Derek Chauvin murder trial will continue and stay in Minneapolis

 

A judge in Minneapolis Friday rejected defense motions to postpone and relocate Derek Chauvin's murder trial in the death of George Floyd.

 

Judge Peter Cahill's rulings came one week after the city agreed to pay $27 million to Floyd's estate -- an announcement defense lawyers argued prejudiced their client in the middle of jury selection. Separately, the judge ruled to allow limited evidence from 2019 encounter between Floyd and the police.


The case moved closer to trial when a woman was selected as the 13th juror after the judge ruled on the motions. Cahill on Friday afternoon said "we're going to try and pick two more" jurors. Jury selection will continue Monday.

Before the #FightBack Foundation came to be associated with lawyer Lin Wood’s post-election conspiracy theories, the non-profit group known by the Twitter hashtag had been affiliated with Kyle Rittenhouse.

 

Rittenhouse was 17 years old when he was charged with killing two men and injuring a third during protests and riots that broke out in Kenosha, Wisconsin, following the police shooting of Jacob Blake. Rittenhouse claimed self-defense, and #Fightback raised the $2 million that his legal team needed to bail him out on Nov. 20, just weeks after a presidential election whose results Wood repeatedly tried to overturn.

 

In exclusive interviews for Law&Crime’s podcast “Objections,” the teenager’s mother Wendy Rittenhouse and #FightBack’s former executive director Dave Han**** speak out for the first time about their demands that the non-profit conduct an audit of the money that was fundraised.

 

Ms. Rittenhouse claims on the podcast that two of #FightBack’s leaders—Wood and conservative firebrand John Pierce—latched onto her son’s case for their own personal reasons.

“They used Kyle to gain money, gain Twitter followers,” Ms. Rittenhouse told Law&Crime. “I felt now they didn’t care about Kyle.”

 

The mother has cut ties with #FightBack to start a new legal defense fund for her son under her control called FreeKyleUSA, and she claims that Wood and Pierce have ignored repeated requests to open up their books.

 

“He used my son’s image to make profit off of that. And I asked for an accounting of it. And I never got it. I was ignored,” Ms. Rittenhouse said of Wood in an interview with Law&Crime. “They used a 17-year-old kid’s image for their own political ****.”

 

“I asked Lin, where’s the money?” Ms. Rittenhouse recalled separately. “I wanted to see the books, like the accounting books.”

 

In an email, Wood denied receiving any request for an audit and said FightBack would be “perfectly willing to undergo any audit required by law.”

Chauvin's defense attempted to portray bystanders as angry mob that diverted officers' attention

 

During his opening statement Monday, the attorney for the former Minneapolis police officer charged with murder in George Floyd's death claimed that the crowd of onlookers who witnessed Floyd's death last May had made the responding officers worry for their safety and diverted their attention from him.

 

On Tuesday, the defense attorney, Eric Nelson, doubled down. He asked four witnesses, including the teenager who recorded the widely seen video of Floyd being detained, whether they and others in the crowd were angry as they watched Floyd pinned on the pavement by the former officer, Derek Chauvin.

 

Nelson had a particularly tense exchange with witness Genevieve Hansen, an off-duty firefighter who came across the scene while out for a walk.

 

Hansen rejected Nelson's assertion that she "got louder and more frustrated and upset" as the minutes ticked by and Chauvin remained on Floyd's neck. She responded that she was "more desperate," adding that she had identified herself as a firefighter. In earlier testimony, Hansen, 27, said she approached the scene and offered to help.

 

Hansen said she didn't become angry until after Floyd was loaded into the ambulance "and there was no point in trying to reason with them anymore because they had just killed somebody."

 

Nelson pressed Hansen to describe other people in the crowd as "upset or angry."

 

A visibly upset Hansen shot back, "I don't know if you've seen anybody be killed, but it's quite upsetting."

The kid feels guilty about causing it, that's cruel. I thought his testimony was powerful in more than just words.

That probably even takes guts, on the part of the officer. Might be "more cops who need to be commended" worthy. 
 

Maybe it shouldn't be such a praiseworthy event. But in the current climate, I think it is.

I saw his entire testimony.  He wrote an open letter after the murder condemning Chauvin's actions.  He was incredibly compelling.

Visitor chair reserved for Derek Chauvin guest removed due to lack of use

 

A chair reserved for a visitor of Derek Chauvin, the former Minneapolis police officer charged with killing George Floyd, was removed from the courtroom during his trial because no one used it, a deputy said Monday. 

 

The deputy told press that if someone does come for Chauvin, the chair will be returned.

 

A chair reserved for a member of Floyd’s family was filled on early Monday. Philonise Floyd, Floyd’s brother, was reported sitting in the seat reserved for their family this past week. 

 

Hennepin County Judge Peter Cahill ruled last month that only one member each of both Floyd’s and Chauvin’s families would be able to attend the trial at a time. The judge also required those who do attend the trial to comply with coronavirus guidelines.
