Insider trading is generally handled by the SEC, specifically the Market Abuse office of the Division of Enforcement (where I interned during law school). The SEC can bring civil actions but not criminal cases. Cases would only get referred to the DoJ if the SEC had determined that criminal charges should be brought. In a normal situation, the fact that DoJ was involved would indicate that the SEC wanted criminal charges brought.
