Judge blocks Trump lawyers from arguing about columnist's rape claim at upcoming defamation trial

 

NEW YORK (AP) — A judge late Saturday said former President Donald Trump’s lawyers can't present legal arguments to a jury assessing damages at a defamation trial on a jury's conclusion last year that he didn’t rape a columnist in the mid-1990s.

U.S. District Judge Lewis A. Kaplan made the determination in an order in advance of a Jan. 16 trial to determine defamation damages against Trump after a jury concluded Trump sexually abused columnist E. Jean Carroll but did not find evidence was sufficient to conclude that he raped her.

Trump, speaking in Iowa on Saturday as the Republican frontrunning presidential candidate in advance of a Jan. 15 primary, criticized the judge as a “radical Democrat” and mocked E. Jean Carroll for not screaming when she was attacked. “It was all made up,” he said.

Trump says he plans to attend E. Jean Carroll defamation trial

 

Former President Trump on Thursday said he wants to attend all of his upcoming trials in person, and he plans to start next week with a trial over defamation damages involving writer E. Jean Carroll.

 

Trump delivered remarks and took questions at 40 Wall Street in New York City following his defense team’s closing arguments in a fraud trial over his business practices, where he sat in the courtroom for much of the proceedings earlier in the day.

 

The former president was asked whether he planned to attend the E. Jean Carroll, trial, scheduled to start Tuesday, the day after the Iowa caucuses.

 

“Yeah I’m going to go to it, and I’m going to explain I don’t know who the hell she is,” he said, claiming her case has been backed by Democratic operatives. Trump is barred from testifying that the sexual assault did not occur.

 

The trial will determine what Trump owes in defamation damages after a jury concluded last year that Trump sexually abused Carroll.

Attorney Joe Tacopina withdraws from Trump's legal team

 

Former President Donald Trump on Monday lost an experienced defense attorney from his legal roster.

 

Joe Tacopina told ABC News, "I withdrew on all matters."

 

Tacopina accompanied Trump when the former president pleaded not guilty in New York last April to charges that he falsified business records stemming from his hush payment to adult film actress Stormy Daniels.

 

Former President Donald Trump on Monday lost an experienced defense attorney from his legal roster.

 

Joe Tacopina told ABC News, "I withdrew on all matters."

 

Tacopina accompanied Trump when the former president pleaded not guilty in New York last April to charges that he falsified business records stemming from his hush payment to adult film actress Stormy Daniels.

 

Tacopina also represented Trump in the civil defamation and battery case brought by former Elle magazine columnist E. Jean Carroll, in which Trump was found liable and ordered to pay Carroll $5 million in damages.

 

Tacopina will no longer handle Trump's appeal of that verdict.

 

Attorney Alina Habba and her partner Michael Maddaio are representing Trump in Carroll's other lawsuit in that case, which is scheduled to go on trial Tuesday in Manhattan federal court.

‘This Argument is Over!’ Trump Lawyer Alina Habba Gets Scolded By Judge Just Minutes Into New Trial

 

CNN reports that Kaplan and Habba got into it when the judge refused her request for the trial to be postponed so Trump can attend his mother-in-law’s funeral. When Habba demanded the trial be temporarily adjourned so Trump could be present for it later, she and Kaplan got into it — as the judge refuted her claims and told her the trial’s procedure has been established. Judge Kaplan added that he will not  hear any more arguments from her on the subject:

“When the ruling is made that is the end not the beginning of argument,” Kaplan said at one point — perhaps as a nod to the lengthy arguments Judge Arthur Engoron allowed in Trump’s recent New York civil fraud trial.

 

Habba requested the judge grant an adjournment Thursday, so Trump does not have to decide whether to be in court at trial or at his mother-in-law’s funeral.

 

“I am asking you, sir, now for a one-day adjournment of this trial” Thursday to “allow my clients to be there so that he can be present for every day of this trial as he has a right to be,” Habba said.

 

“I am not stopping him from being there,” Kaplan said.

 

“No, you’re stopping him from being here, Your Honor,” Habba responded.

 

“The argument is over,” Kaplan said, declining to change his previous ruling.

'Make him stop': Jury told Trump defamed E. Jean Carroll with '22 posts just today'

 

Shawn Crowley, an attorney for E. Jean Carroll, urged a jury to fine Donald Trump enough money so that he would never defame her client again.

 

Crowley noted that Trump has continued to post about Carroll on social media — including during the trial which started Tuesday.

 

"How much money will it take to make him stop?" Crowley asked. "Because he has not stopped."

 

"He sat in this courthouse — you saw him — [and] while he was sitting here, he posted more defamatory statements," she added. "More lies about Ms. Carroll & this case. By our last [count], 22 posts just today. Think about that when you consider how much money it will take to get him to stop."

It's already working in these cases.  The more he delays, the more time he spends not in-jail-for-the-rest-of-his-miserable-old-ass-life.

Thats fair, but I dont think it will work long term... Even if he wins in November, he cant pardon the Georgia case...

Trump lost his best possible juror in the E. Jean Carroll defamation trial: a man who thought the 2020 election was stolen

 

As jury selection began Tuesday in E. Jean Carroll's second defamation case against former President Donald Trump, Judge Lewis Kaplan asked the potential jurors a question: did any of them believe the 2020 election was stolen from Trump?

 

A man in a red sweater — juror number 68 — raised his hand. He and another woman were the only two out of the roughly six dozen prospects in the New York courtroom who raised their hands.

 

Juror 68 was also the only person among prospective jurors who said he had attended a Trump rally.

 

He was quickly booted, however, after the judge asked whether anyone in the jury box felt Trump was being unfairly treated by the US court system.


Juror 68 wasn't sitting in the jury box. But he was so enthusiastic about voicing his opinion on the matter that he stood up while seated in the audience.

 

Kaplan dismissed him shortly after, meaning the former president likely lost one of his best jurors in the second Carroll defamation trial.
