Jared Kushner and Ivanka Trump Subpoenaed in Jan. 6 Investigation

Former President Donald J. Trump’s daughter Ivanka and his son-in-law Jared Kushner have been subpoenaed by the special counsel to testify before a federal grand jury about Mr. Trump’s efforts to stay in power after he lost the 2020 election and his role in a pro-Trump mob’s attack on the Capitol on Jan. 6, 2021, according to two people briefed on the matter.

The decision by the special counsel, Jack Smith, to subpoena Ms. Trump and Mr. Kushner underscores how deeply into Mr. Trump’s inner circle Mr. Smith is reaching, and is the latest sign that no potential high-level witness is off limits.

The disclosure about the subpoena comes two weeks after it was revealed that Mr. Smith had subpoenaed former Vice President Mike Pence to testify before the grand jury.

FBI Thinks Trump Playing ‘Shell Game’ With Classified Docs After Box Found in ‘Bridal Suite At Mar-a-Lago’

Federal authorities investigating former President Donald Trump believe he’s playing a “shell game with classified documents” after another box was discovered after several searches and a lengthy journey to the Mar-a-Lago bridal suite that now serves as Trump’s office, say CNN sources.

CNN reporting teams have been breaking scoop after scoop on the Justice Department probes into Trump’s mishandling of classified information under the Espionage Act and his conduct surrounding the January 6 insurrection, which are now being headed by special counsel Jack Smith.

The latest scoop comes from Katelyn Polantz, Paula Reid, and Jeremy Herb, and involves the long and strange journey of a box containing classified material that was discovered in December — after the FBI searched the property and Trump aides had searched the property as well.

Some of the report’s key revelations include a colorful description of the box’s journey and some newsy tidbits as well. For example:

Quote
  1. “Investigators working for special counsel Jack Smith in recent weeks have interviewed a Trump aide who copied classified materials found in the box using her phone to put them onto a laptop. After a voluntary interview with the aide, prosecutors subpoenaed the password to the laptop, which she provided, according to one of the sources.”
  2. “People familiar with the Trump legal team’s efforts to locate documents describe a confusing chain of events that delayed discovery of the box, including having its contents uploaded to the cloud, emailed to a Trump employee, and moved to an offsite location before finally ending up back at a Mar-a-Lago bridal suite that is now Trump’s office – the very place that the FBI had searched just weeks earlier.”
  3. One person who described the box’s movements and the special counsel’s inquiry into it described federal investigators as suspecting a ‘shell game with classified documents.’ The person said Trump’s daily movements and instructions to staff are a core part of prosecutors’ questions as well.”

Former Arizona AG sat on records refuting election fraud

PHOENIX (AP) — Arizona's former attorney general suppressed findings by his investigators who concluded there was no basis for allegations that the 2020 election was marred by widespread fraud, according to documents released Wednesday by his successor.

Democratic Attorney General Kris Mayes, who took office last month, said the records show the 2020 election “was conducted fairly and accurately by election officials.”

Previous Attorney General Mark Brnovich, a Republican, never released a March 2022 summary of investigative findings, which ruled out most of the fraud claims spread by allies and supporters of former President Donald Trump. Yet a month later, he released an “interim report" that claimed his investigation “revealed serious vulnerabilities that must be addressed and raises questions about the 2020 election in Arizona."

He released his April report despite pushback from his investigators who said some of its claims were refuted by their probe. Brnovich was at the time in the midst of a Republican Party primary for U.S. Senate and facing fierce criticism from Trump, who claimed he wasn't doing enough to prosecute election fraud.

Fontes says Brnovich should be disbarred for withholding Arizona election investigation findings

Arizona Secretary of State Adrian Fontes believes Mark Brnovich should be disbarred after documents released Wednesday revealed the former state attorney general kept complete findings of the 2020 election investigation under wraps.

“Yes, he should be disbarred,” Fontes told KTAR News 92.3 FM’s Gaydos and Chad Show.

Judge rejected Perry’s bid to shield thousands of emails from Jan. 6 investigators

The chief judge of the federal district court in Washington, D.C., secretly rejected Rep. Scott Perry’s bid to shield more than 2,000 messages relevant to Justice Department investigators probing efforts by Donald Trump to subvert the 2020 election, according to newly unsealed court filings.

U.S. District Court Chief Judge Beryl Howell unsealed her extraordinary Dec. 28 decision on Friday evening, determining that the “powerful public interest” in seeing the previously secret opinion outweighed the need for continued secrecy.

Perry, a Republican lawmaker from Pennsylvania, had urged Howell to block the Justice Department from accessing 2,219 documents stored on his phone, which was seized and imaged by the FBI last August as part of the 2020 election investigation.

He claimed that the records reflected his efforts to research potential legislative decisions — like whether to vote to challenge election results on Jan. 6, 2021 — and therefore should be protected from disclosure by the Constitution’s speech or debate clause, a provision meant to safeguard lawmakers from pressure or intimidation by the executive branch.

But Howell said Perry had taken an “astonishing view” of his immunity that would effectively put members of Congress above the law and free of political consequences for their actions. She ordered him to disclose 2,055 of the documents he sought to withhold — including all 960 of his contacts with members of the executive branch, which she said are entitled to no constitutional protection at all. Some 161 items, she said, were proper to withhold.

Media outlets demand access to Jan. 6 footage sent to Tucker Carlson

A coalition of news outlets is demanding access to footage from the Jan. 6, 2021 attack on the U.S. Capitol that House Speaker Kevin McCarthy (R-Calif.) shared exclusively with Fox News anchor Tucker Carlson.

Attorney Charles Tobin sent a letter to Congress on Friday requesting the footage on behalf of Advance Publications, ABC News, Axios, CNN, CBS News, The E.W. Scripps Company, Gannett, the Los Angeles Times, Politico, and ProPublica.

The letter was addressed to McCarthy, House Majority Leader Steve Scalise (R-La.), House Minority Leader Hakeem Jeffries (D-N.Y.), Senate Majority Leader Chuck Schumer (D-N.Y.), and Senate Minority Leader Mitch McConnell (R-Ky.).

In the letter, a copy of which was obtained by The Hill, Tobin wrote, "Without full public access to the complete historical record, there is concern that an ideologically-based narrative of an already polarizing event will take hold in the public consciousness." The letter added that this could cause "destabilizing risks to the legitimacy of Congress, the Capitol Police, and the various federal investigations and prosecutions of Jan. 6 crimes."

In addition, NBC News reported that another group of news outlets had also filed a separate request seeking the footage. This group included NBC, The Washington Post, The New York Times, The Associated Press, Telemundo, and others.

"There is no basis for further delaying granting this access — to these News Organizations or any other media outlets that make similar requests," this request said, per NBC.

The controversy stems from McCarthy's handing over of exclusive Jan. 6 footage to Carlson this past week. The Washington Post noted that Carlson "has repeatedly cast doubt on official accounts of what happened on Jan. 6 and has claimed it was a 'false flag' operation."
