I think it's fine, I don't care about a billion dollar industry having to pay up. However, when legislators pass laws or tort reform to put a maximum on what a company has to pay (no matter the level of negligence on the part of the company), well, I don't like that.

The biggest issue this country needs accomplished is Tort reform. But it is never going to happen as lawyers have too much sway in both parties.

The reasonable action for the casino would have been to dry the ****ing floor so nobody falls.  Would that have been so hard?  So first they failed to do that, they just put up a sign which is seriously the bare minimum and just lazy AF.  Then the sign fell and a casino employee saw it and just walked around it and didn't stand it back up or tell anyone else.  So they had two chances to not **** this up, they failed both times, so at that point they are on the hook if someone gets hurt.  If someone had fell and just gotten back up, embarrassed but unhurt, then they wouldn't have any liability.  Unfortunately, the person that fell did actually seriously hurt herself, so the casino lost their bet, so to speak.

Here's a fun legal doctrine to learn on a Monday:  https://en.wikipedia.org/wiki/Eggshell_skull

Quote

This rule holds that a tortfeasor is liable for all consequences resulting from their tortious (usually negligent) activities leading to an injury to another person, even if the victim suffers an unusually high level of damage (e.g. due to a pre-existing vulnerability or medical condition)...The term implies that if a person had a skull as delicate as that of the shell of an egg, and a tortfeasor who was unaware of the condition injured that person's head, causing the skull unexpectedly to break, the defendant would be held liable for all damages resulting from the wrongful contact, even if the tortfeasor did not intend to cause such a severe injury.

The lady, who let's face it, is probably not an impressive physical specimen to begin with (pure speculation by me), has already undergone serious surgery and lost mobility for the rest of her life.  Her lawyers are probably getting half or more of the award, but that's the casino's fault for taking it to trial.

"Tort reform" is a scam pushed by big corporations that dislike being held responsible when they hurt people.  Calling it the "biggest issue this country needs accomplished" is the most ridiculous thing I've heard since Juan Soto didn't make the all star team.

I think the amount awarded is ridiculous.  Medical bills paid for, loss of wages and a nice chunk of cash if it prevents her from working again sure.  Three million?  nope.

I'm curious to know if there were witnesses seeing the employee walk by the sign or if that was her story.  Cause if it was her story, shouldn't she know the sign was there and it was wet?

Slip and fall cases suck anyhow, I was involved in one as an employee (age 16 - grocery store) where the lady fell, nobody saw her at all, after she walked by me and saw me mopping the floor (yes - I had wet floor signs up and it said it on the mop bucket).  What made it worse was it was one of the managers mother in law (whom he disliked).

Could they just make people sign a waiver instead of eliminating activities?

Yesterday I went to a petting zoo for an adult night where they had bounce houses and go karts etc., plus alchohol.

They made us all sign waivers and that made total sense, but it makes me wonder that if they can eliminate their liability this way why cant everybody?

Are we going to get to a point where every single place you walk into that could possibly be responsible for your well being is going to make you sign a waiver?

Not even sure if waivers would be enforceable in a place like a casino or a grocery store where there are no inherent dangers and I'm sure if they were, they'd already be doing it.

That sounds destined to backfire in this new Mass Shooting age we're in, no run intended.

I feel like if you're going to be a shameless money maker you gotta either risk some personal injury or sell a product that doesn't work.  Which could technically fall under being a political shill depending on how you look at it.

Criteria: Shameless and money making

Porn???

A few years ago I was walking up to the Lowe's return desk and I slipped on a puddle of soda, I know it was soda because it was brown. I did one of the cartoon skids on one foot for about 3 feet, fell backwards in a limbo fashion and caught myself falling backwards with both arms. I did this right in front of the service desk. I told the customer service rep what happened and he just said "ok", no one cleaned it up. I really hope someone else slipped in that puddle, fake or not and sued their asses off.
