Police say he appeared to be slurring his speech and his eyes were red, and appeared to have been smoking marijuana. Chris Simms has been on the bubble of being out of the NFL for a while now. I just had court last week for the same charge. Recalcitrant cops. They couldn't charge me with possession b/c of my card so they charged me with a DUI instead. The Department of Justice wrote to the prosecuting attorney saying that although she could prove I had metabolized THC in my system, there's no body of evidence that correlates certain THC thresholds with impairment. Lacking scientific tests, you are left with the subjective opinion of the cop. And having failed the FST sober, I can attest that FSTs are not a good measure and are easily manipulated. That said, my judge was very adamant that my case was not about if I had smoked pot or not, but rather if the DA could prove I was impaired or not. The judge used the analogy that you could have a couple glasses of wine with dinner and be safe to drive. Much to the DA's chagrin, the judge held her to the measure of proving I was impaired. The DA couldn't prove ****. The DoJ gave an opinion that the DA didn't have a case. Case dismissed. *******s. Regarding the Simms matter, the same measure applies: the cop needs to prove Simms was impaired. Red eyes and odor, please, that doesn't make one impaired. They pulled that slurred speech with me and I was sober. And who the hell slurrs when they're high, I don't know anyone who does. It all sounds like a bunch of bull**** predicated on the subjective opinion of what is obviously another recalcitrant cop. This was via their NFL tv shows on opposing networks. The spat followed Young's comments about the intelligence of Chris Simms as a QB. Steve Young should get a chuckle out of this. Personally, I don't mind if players smoke weed, but I don't want my QB getting busted for it. If any other position player gets busted I don't care as long as he's not suspended.
