Teen Faces Child Porn Charges For Posting Pics Of Friends

ALLEGAN, Mich. -- A Michigan high school student faces child pornography charges over an Internet party prank.

Prosecutors charge Ryan Zylstra, 17, posted a picture of two teens having sex on his blog. The photo was taken at a New Year's Eve party at Zylstra's home.

Authorities said the boy in the picture is 17, while the girl is 16. According to prosecutors, the age of the girl makes the sexually explicit picture child pornography under the law.

Zylstra now faces up to 20 years in prison if convicted of the most serious charges, which are felonies.

Tuesday, Zylstra was in court and waived a preliminary hearing. The decision means his case will be bound over for trial in Allegan County Circuit Court.

No trial date has been set.

You know I've always wondered about this. I had a girlfriend back in high school who always wanted me to take pictures of her. I was skeptical because of laws like that. (Yeah, I'm probably just a big *****, though.) But I thought about it and wondered what would happen? We were both 16 and she was consenting so I figured I couldn't get in trouble. I never took them though. This is interesting.

Baha. I just am way too paranoid about things like that. I didn't know if I would get in trouble. And given my luck I probably would have. So I thought better of it.

I mean look at that story up there. That kid didn't think he would get in trouble. Although he's a dumbass for posting the picture on his web blog. I would have never done that.

WOW...at 16 my only thoughts would have been......will I run out of film? how cool will my friends think these pics are? will my parents come home before I finish shooting the the 50th roll? where will I get these developed? will this lead to a career in porn?

why would you worry of taking pics? since there are digital cameras now, after your done, you save them to your hard drive in a hidden, password-protected folder and delete em from your camera memory.....not that Id have any idea....just thinking out loud.....

yeah but, he posted them, and there's always a trail on your comp. Even if you put them in the trash, there is a shadow of it, and can be retrieved.

If you can't consent to sexual acts below a certain age, but you can be charged with an adult crime of taking a pic and posting it to a site and you're within ONE YEAR of the 'victim?!!!' And face a ruined life, reputation and jail time?

What a joke. Guess they ran out of real child rapists to let out of prison to commit more crimes.

That's how he got caught. He posted them on his myspace site. which is just plain stupid. Besides why post pics of someone else having sex on your site...sheesh what's he trying to be proud of? Now if he took pics of himself having sex with the girl and posted them...

I was thinking that too. I know in VA it's not statutory rape if the boy is less than two years older than the girl even if the girl is underage. I guess porn laws are different.

That said, how stupid does this kid have to be to put that on the interenet?

Yea, but not many people reformat their hard drive with several swipes of random data as filler (to overwrite any files that could potentially be retrieved EVEN AFTER you reformat it) . Using an XP disc to reformat doesn't mean its gone. It is there, but the file table no longer lists it. It will be there until another file takes its spot. Paranoid? Go buy Windows Washer. Just a tip -- especially if any of you like to donate old computers and don't want anyone sniffing around for old data.

Anyways, I don't think this kid will get a real harsh penalty for child pornography, but charges of slander and such could be an issue...

you can always reformat your hard drive and wipe all the past info off.

actually no. a format only wipes the MBR and the beginning of each sector on the disk, there's still plenty of data behind in the rest of the sectors of the HDD that, were you being investigted by the FBI, they could reconstruct a large portion of what was there previously that had not been totally overwritten by other data at least twice.

if you /really/ want to clean a HDD, you get a utility that works at the physical layer of the HDD. Try Googling "DOD 5220".

somewhere the FBI has burried on their page how to format a hard drive so as they couldn't retrieve any date, it had something to do with complying with a privacy law or something. I read it once but I couldn't find it again, but if I remember correctly it involved 8 sweeps of formatting and filling the drive with random bytes of data... That could take a really long time if one were to try it. I have a program that will retrieve data that has been formated over but it only really works for retrieving the data cleanly providing you haven't written over those sectors so I think that 1 or 2 times through should make it safe for donation.

Yea, magnets isn't a good idea if you want to use it again. If you want to delete it with no trace, use the program I suggested, Windows Washer, or simply open the file in a text editor and add in various numbers and characters in the first line, and perhaps add in text in other places to really make it un-recoverable. Windows Washer does a better job because it even makes the slack space have nonsense (slack space = the space not used by a particular file, but is allocated to it anyways. ie: you don't necessarily always fill up your tank with gas, even though you have the room.)

BTW - Windows Washer allows you to have up to ridiculous amounts of sweeps. It has options for 1 sweep, as well as DoD (3) and NSA (7) or Gutmann (35). Great software for privacy.
