Trump’s Appeal Could Be Short-Lived for a Simple Reason Donald Trump is working hard to get an appeal of the $464 million judgment levied against him for committing bank fraud. But if he does fork over the cash and get that appeal, he may find that it doesn’t take the higher courts long to swat it down. That’s because the 92-page opinion issued by New York Supreme Court Justice Arthur F. Engoron was tailor-made to withstand appeal—and give the state’s First Judicial Department a roadmap to uphold the decision. “The reason why this opinion is so long and so specific is to emphasize to the appellate court how much care the judge took in issuing this decision,” said Jennifer B. Arlin, an expert on appeals who teaches legal writing at Brooklyn Law School. A review of the judgment demonstrates that it was structured in an unusual format, one that dedicates a disproportionate amount of space to analyzing the facts presented during the 11-week trial—and provides a simple guide for an appellate court to quickly examine it, understand the judge’s reasoning process, and come to a swift decision. “It's so well laid out that it says, ‘Go ahead—challenge me,’” said Diane Peress, a former prosecutor who now teaches at John Jay College of Criminal Justice. https://www.thedailybeast.com/trumps-appeal-could-be-short-lived-for-a-simple-reason
  3. Looks like this is turning into a 3-times per year vax for old folks... Why Older Adults Need Another COVID-19 Shot Older adults should get the COVID-19 vaccine more frequently than previously recommended, according to new guidance from the U.S. Centers for Disease Control and Prevention (CDC). Health officials are urging people ages 65 and older to receive another vaccine dose in the spring, or at least four months after their most recent dose. CDC director Dr. Mandy Cohen announced the decision after a CDC advisory committee, which is made up of independent vaccine and infectious disease experts, voted 11-1 to make the change. “An additional vaccine dose can provide added protection that may have decreased over time for those at highest risk,” she said in a statement https://time.com/6836390/older-adults-covid-19-vaccine-2024
  4. Trump fan who assaulted officers with a hockey stick on Jan. 6 is sentenced to prison WASHINGTON — A Donald Trump enthusiast who believed the former president's lies about the 2020 election was sentenced Wednesday to more than three years in federal prison for assaulting law enforcement officers with a hockey stick during the brutal battle at the lower west tunnel of the U.S. Capitol during the Jan. 6 attack. Michael Joseph Foy was arrested in January 2021 and was initially held in pretrial detention. He was found guilty of felony charges in June. Federal prosecutors sought more than eight years in federal prison, saying Foy assaulted officers with a hockey stick and a sharpened metal pole after he traveled to Washington with a "TRUMP 2020" flag. But U.S. District Judge Tanya Chutkan — who is overseeing Trump's delayed federal trial on charges he tried to overturn his 2020 election loss by conspiring to obstruct Congress and disenfranchise American voters — said Wednesday that the Justice Department's request was "unreasonable" and that it didn't factor in Foy's military service and other factors in his life in the lead-up to Jan. 6. Chutkan ultimately landed on a sentence of 40 months, meaning Foy will end up serving an additional two years and a few months in federal prison. https://www.yahoo.com/news/trump-fan-assaulted-officers-hockey-221621341.html
  5. I didn't know that about Rutledge. That's good. He got hit a bit in the 2nd but had much better control. Hassell looks so confident at the plate. He also made a nice grab in CF. Yeah, I saw the Wood hit live. I didn't realize he had that kind of speed - I think they said 4.07 to 1st & is the fastest on the team. Crews with another SB yesterday. Impressed by all of the pitching yesterday - Herz was a mixed bag of good and bad pitching. He, too, may have been working on a new pitch. They said the catchers will be spending more time on 1 knee this season even with runners on base. I think it helps them frame pitches better & gives the umps a better view. I noticed the Sox doing the same with their catchers.
  6. Finnegan looked like he was in midseason form. Crews with a bad K with the bases loaded & 1 out. IF single his next AB. Gallo had a nice 2B to score a couple. Didn't realize how big Gallo is.
  7. I bought English muffins last week. I can't believe how small they are now. I piece of fake sausage almost covered the entire muffin! I won't be buying them anymore...
  8. Yay...Nats on MASN at 1:05pm in RVA today. Rutledge off to a bad start. Walked the bases loaded & 26 pitches. Ground out to end the inning - 27 pitches 1 K 3BB
  9. A woman lost her $823,000 injury claim after lawyers found a photo of her winning a Christmas-tree-throwing competition A woman in Ireland who sued an insurance company for $823,000 had her injury claim tossed out after the court saw a photo of her taking part in a Christmas-tree-throwing competition. Kamila Grabska, 36, sued RSA Insurance over what she said were back and neck pains from a car crash in 2017, the Irish Independent reported. The accident rendered her unable to work for more than five years, she said. https://www.businessinsider.com/woman-loses-823000-injury-claim-christmas-tree-throwing-photo-2024-2?amp
  10. Noticed in the box score yesterday Ruiz had 2 Es - both for catcher interference. The new mechanics obviously include pushing him forward in the box. Those milliseconds should improve his throw time to 2nd. He just needs to figure out how close he can get & still stay away from the swing.
  11. Did Robles play winter ball? If so, how did he do? I suspect his back will never be the same which means his defense will never be as good as it was.
