Republican Joe Miller is not giving up his fight in Alaska's Senate race.Sen. Lisa Murkowski has already declared victory over her Tea Party rival, but Miller has now taken his battle to a state court.

A federal judge looking at Miller's original lawsuit, which challenged how write-in ballots for Murkowski were being counted, told Miller the matter was for the state.

Murkowski says she'll intervene so voters aren't "disenfranchised" by Miller. A hand count of write-in ballots showed Murkowski leading Miller by 10,000 votes.

The outcome of the legal wrangling won't change the Senate's partisan tilt. Democrats will control 53 votes, including those of two independents, and Republicans will have 47 when Congress is sworn in Jan. 5.

Granted, she has the votes to win. Maybe Miller should not be fighting as hard as he is, but someone should at least note that the state law says the name must be spelled right. Murkowski has the votes either way, but really? "disenfranchised?" Let me just say that people involved in a write-in campaign should know how to spell the freaking candidate's name, and be able to form some legible letters to do so. If you are voting in a WRITE-IN campaign and cannot WRITE, that is pretty much the definition of epic fail.

That was mostly my opinion on Al Gore in The Florida Election. Florida law was clearly on his side, but sometimes following the law isn't the moral thing to do.

al franken lost and didnt quit kept recounting till he got the vote count the way he liked it

Yeah, because Al Franken got to decide which votes were counted, not the Minnesota election officials. The ultimate review was by the Minnesota Canvassing Board which had more Republicans than Democrats on, and which Coleman agreed was impartial.

:secret: Conservative mythology has decided that the Franken race was fixed. Nothing you can say will dent that belief.
