Georgia prosecutor says Trump probe will look at intent

 

The prosecutor investigating whether Donald Trump tried to influence the result of Georgia’s 2020 presidential election suggested the former president knew what he was doing when he asked a state official to “find” one more vote than he needed to win.

 

Fulton County District Attorney Fani Willis is investigating Trump after a Jan. 2 telephone call he made pressuring Secretary of State Brad Raffensperger to overturn the state’s election results based on unfounded voter fraud claims.

 

In the call with Raffensperger, which was recorded, Trump says: “All I want to do is this: I just want to find 11,780 votes, which is one more than we have,” referring to the narrow margin of President Joe Biden’s victory in the state, one of a handful of swing states that cost Trump the White House.

 

Investigators will examine whether a suspect understood the implications of his actions, Willis, a Democrat, said in an interview with MSNBC on Thursday night, without naming Trump.

Graham’s post-election call with Raffensperger will be scrutinized in Georgia probe, person familiar with inquiry says

 

An Atlanta-area prosecutor plans to scrutinize a post-Election Day phone call between Sen. Lindsey O. Graham (R-S.C.) and Georgia Secretary of State Brad Raffensperger as part of a criminal investigation into whether former president Donald Trump or his allies broke Georgia laws while trying to reverse his defeat in the state, according to a person familiar with the probe.

 

The individual, who spoke on the condition of anonymity because of the ongoing probe, said the inquiry by Fulton County District Attorney Fani Willis will include an examination of the call Graham, a staunch Trump ally, made to Raffensperger 10 days after the Nov. 3 election.

 

During their conversation, Graham asked the Georgia secretary of state whether he had the power to toss out all mail ballots in certain counties, Raffensperger told The Washington Post in an interview days later. He said Graham appeared to be asking him to improperly find a way to set aside legally cast ballots.

After averting a conviction in his second impeachment trial, former President Donald Trump faces significant new legal threats as prosecutors in Georgia have joined those in New York to conduct criminal investigations into his actions.

 

In the three weeks since Trump left the White House, the multiple legal threats he faces have increased and become more imminent.

 

Georgia officials announced that the former President faces two new investigations over calls he made to election officials in an attempt to overturn the state's election results.

A source familiar with the Georgia secretary of state's investigation confirmed they are investigating two calls, including one Trump made to Secretary of State Brad Raffensperger.

In the January call, audio of which was obtained by CNN, Trump is heard pushing Raffensperger to "find" votes to overturn the election results after his loss to then-President-elect Joe Biden.

"This is not an easy case, but it's not one that you should walk away from investigating," said Bret Williams, a former federal prosecutor in New York and Atlanta. "It will be tough to show that he had intent to solicit Raffensperger to commit election fraud but he may have."

Trump's senior adviser, Jason Miller, said in a statement to CNN that there was nothing "improper or untoward" about the scheduled call between Trump and Raffensperger.

"If Mr. Raffensperger didn't want to receive calls about the election, he shouldn't have run for secretary of state," Miller said in the statement.

The investigation also involves a call Trump made in December to a Georgia election investigator in the state secretary of state's office who was leading a probe into allegations of ballot fraud in Cobb County. Trump is heard asking the investigator to "find the fraud," saying the official would be a "national hero."

The second Georgia investigation is being conducted by the Fulton County District Attorney's office, which announced Wednesday that it has also opened a criminal investigation into Trump for his "attempts to influence the administration of the 2020 Georgia general election."

"Anyone that violates the law will be prosecuted, no matter what their social stature is, no matter what their economics are, no matter what their race is or their gender. We're not going to treat anyone differently," Fulton County District Attorney Fani Willis told CNN affiliate WSB in an interview earlier this week.

The earliest a Fulton County grand jury is expected to convene is in March, and the district attorney's office can request grand jury subpoenas as necessary at that time.

"I believe laws were broken because I think it was a clear effort by at the time a President of the United States, who I think at the time also wielded a certain amount of power to influence the secretary of state to do something wrong," said Michael J. Moore, a former US Attorney for the Middle District of Georgia during the Obama administration.

"I think that's what the statute says, and if those things happened, that's a violation of law," he said.

Rep. Bennie Thompson and NAACP sue Trump, Giuliani, Proud Boys, and Oath Keepers.

 

The NAACP and Rep. Bennie Thompson are suing former President Donald Trump and his personal lawyer Rudy Giuliani, alleging that they violated a 150-year-old law by conspiring to incite the violent Jan. 6 insurrection with the goal of preventing the certification of the 2020 presidential election results.

 

The lawsuit alleges that Trump and Giuliani, along with the right-wing groups, worked to incite the riot in a bid to stop Congress from certifying President Joe Biden's election win, and in doing so violated the 1871 Ku Klux Klan Act, a Reconstruction-era law that protects against violent conspiracies meant to stop Congress from carrying out its Constitutional duties. The law at the time was passed in response to KKK violence and intimidation against Southern members of Congress.

The Manhattan District Attorney’s Office has subpoenaed a New York City property tax agency as part of a criminal investigation into Donald Trump’s company, the agency confirmed on Friday, suggesting prosecutors are examining the former president’s efforts to reduce his commercial real-estate taxes for possible evidence of fraud.

Report: Giuliani Tried To Dodge Service In $1B Dominion Voting Lawsuit

 

“After not responding to requests to waive service, Mr. Giuliani evaded in-person service of process for nearly a week. It took numerous attempts, at both his home and office, before we were able to successfully serve Mr. Giuliani on February 10. Mr. Giuliani’s repeated false claims about Dominion have been immeasurably damaging; this service of process is one more step forward in our pursuit of justice,” said Tom Clare, an attorney for Dominion.

 

Giuliani said he welcomed the court fight after Dominion sued last month.

 

“Dominion’s defamation lawsuit for $1.3 billion will allow me to investigate their history, finances and practices fully and completely,” Giuliani proclaimed.

Criminal Investigation Against Giuliani Reportedly Resumes

 

A federal criminal investigation into Rudy Giuliani’s dealings in Ukraine is reportedly resuming after stalling in the final months of the Trump administration, the Associated Press reported Friday, the latest in a string of bad news for President Donald Trump’s longtime attorney.

 

The U.S. attorney’s office at the Southern District of New York has “returned to” its investigation of Giuliani, according to the AP, after the probe reportedly was paused by Trump-era officials who slow-walked a request for a search warrant to obtain the attorney’s electronic records.

 

While the full parameters of the investigation are not yet clear, it is reported to include an examination of whether Giuliani’s work in Ukraine violated U.S. lobbying laws, and previous reports indicate prosecutors are also looking into such other potential crimes as money laundering, obstruction of justice and campaign finance violations.

Officials located December recording of Trump call in a trash folder on Georgia investigator's device

 

Officials in the Georgia Secretary of State's Office located a recently released recording of former President Donald Trump's call to a state investigator in a trash folder on her device, a state official familiar with the situation confirmed to CNN.

 

The discovery of the call comes after state officials originally told CNN that they did not think audio of the call existed. The call added to the examples of Trump's extraordinary efforts to push false claims of widespread voter fraud and influence Georgia election officials as they certified the state's election results.

The audio file of the December 23 call between the former President and investigator Frances Watson was discovered as the Georgia Secretary of State's Office responded to a public records request. The personal familiar spoke with CNN on the condition of anonymity to describe the internal process.

The Washington Post first reported the details of how the audio of the December phone call emerged.

Watson declined comment to CNN through the Georgia Secretary of State's press secretary.

CNN previously reported that in the December phone call to the Georgia Secretary of State's Office, Trump urged their top investigator, Watson, to find fraud in the 2020 presidential election, telling her that she would be a "praised" for overturning results in favor of President Joe Biden.

Florida Democrats call for election redo after former state senator allegedly tampered with race

 

Florida Democrats are demanding a special election take place for a state Senate seat after a Republican was accused of tampering with last year’s contest that could have thrown the race to the GOP.

 

The Democrats are calling on state Sen. Ileana Garcia (R) to resign and for officials to set up a special election after former Republican state Sen. Frank Artiles was arrested on Thursday for allegedly planting a shadow candidate to defeat Democratic incumbent José Javier Rodriguez in state Senate District 37.

 

“Her victory is clearly tainted and will forever cast a cloud on her service in the Senate, not to mention the entire Florida Senate. In the interest of fairness and the sanctity of our Democratic electoral process, we call on Sen. Garcia to resign immediately and that a fair special election be held as soon as possible,” Florida Democratic Party Chair Manny Diaz said at a press conference Friday.

Four people, including justice of the peace, arrested on 150 counts of voter fraud

 

An area Justice of the Peace has been arrested and accused of election fraud, along with three other people.

 

Medina County, Texas Justice of the Peace Tomas Ramirez was arrested Feb. 11 after a Bandera Grand Jury indicted him and three others two days prior.

 

Ramirez, a Republican, is facing one count of organized election fraud, one count of assisting voter voting ballot by mail and 17 counts of unlawful possession of a ballot or ballot envelope.

Leonor Rivas Garza, Eva Ann Martinez and Mary Balderrama were also arrested.

 

Garza is facing one charge of organized election fraud, two counts of illegal voting, eight counts of unlawful possession of a ballot or ballot envelope, two counts of election fraud and four counts of fraudulent use of an absentee ballot by mail.

 

Martinez is facing one count of organized election fraud, nine counts of illegal voting, 28 counts of unlawful possession of ballot or ballot envelope, three counts of purportedly acting as an agent, five counts of tampering with government record, 14 counts of election fraud and four counts of fraudulent mail ballot application.

 

Meanwhile, Balderrama is facing one count of organized election fraud, nine counts of illegal voting, two counts of unlawful possession of ballot or ballot envelope, one count of mail ballot application, two counts of unlawfully assisting voter voting by mail, two counts of tampering with government record, eight counts of election fraud.

MSNBC and NBC News legal analyst and former federal prosecutor Glenn Kirschner told SiriusXM host Dean Obeidallah that former President Donald Trump’s apparent attempt at a reputation rehab won’t help him avoid jail.

 

On Tuesday’s edition of The Dean Obeidallah Show, the host talked with Kirschner about Trump’s recent appearances on friendly media outlets.

 

“He was on, yesterday, Fox News, he was on a Fox News podcast, Newsmax, he’s talking about immigration,” Obeidallah said, and added that it seems like “they are trying to rehabilitate his reputation.”

 

“They let him lie about the election, they don’t ask too many questions about January 6th . how does that strike you as a former prosecutor, seeing this effort here in front of us to try to turn the page on an attack on our Capitol?” Obeidallah asked.

 

“Yeah, you know it’s upsetting in the extreme, but I’m going to say, justice is coming,” Kirschner said. “Because everything I see out of the New York District Attorney’s office, every indicator is there moving toward an indictment.”

 

“Everything I see out of the Fulton County DA in Georgia impresses the heck out of me, they’re going to move toward an indictment because the crime itself is caught on a recorded phone call,” he continued. “All of the evidence supporting all of the elements of those Georgia election crimes are really proved by that phone call.”

U.S. District Court Judge Paul Gardephe’s ruling generally steered clear of the constitutional issues presented by such agreements in the context of political campaigns. Instead, the judge — an appointee of President George W. Bush — said the sweeping, boilerplate language the campaign compelled employees to sign was so vague that the agreement was invalid under New York contract law.

 

“The vagueness and breadth of the provision is such that a Campaign employee would have no way of what may be disclosed, and, accordingly, Campaign employees are not free to speak about anything concerning the Campaign,” wrote Gardephe. “The non-disclosure provision is thus much broader than what the Campaign asserts is necessary to protect its legitimate interests, and, therefore, is not reasonable.”

 

Gardephe’s 36-page decision said a non-disparagement clause in the agreement was similarly flawed.

 

“The Campaign’s past efforts to enforce the non-disclosure and non-disparagement provisions demonstrate that it is not operating in good faith to protect what it has identified as legitimate interests,” the judge added. “The evidence before the Court instead demonstrates that the Campaign has repeatedly sought to enforce the non-disclosure and non-disparagement provisions to suppress speech that it finds detrimental to its interests.”

But that single contribution — federal records show it was his first ever — quickly multiplied. Milwaukee Asks to Sanction Trump on ‘Baseless’ Election Suit

 

Donald Trump and his lawyers should pay more than $65,000 in legal fees to Milwaukee County and face additional sanctions for filing a “baseless” lawsuit trying to overturn the result of the presidential election, Wisconsin’s biggest metropolitan area told a judge.

 

The former president never had a valid reason to sue to toss out Wisconsin’s 3.3 million votes, a long-shot effort that would have paved the way for the state’s GOP-dominated legislature to appoint a slate of electors more favorable to Trump, the county said in a filing Thursday in federal court in Milwaukee.

 

“Trump never offered any legal or factual basis for his breathtaking request, and none exists,” the county, a heavily Democratic area in a swing state, said in the filing. “The relief he sought was entirely baseless and amply justifies the imposition of sanctions.”

 

Wisconsin Governor Tony Evers filed a similar request last week seeking $145,000 in legal fees incurred by the state. 

 

Also on Thursday, former Trump campaign attorney Sidney Powell asked a judge to deny a similar request for sanctions against her in a separate suit she filed in Wisconsin to overturn the election result. Powell represented a Trump voter in that case, which also failed. The state is seeking $106,000 in legal fees from Powell, saying her case alleging a vast voter-fraud conspiracy involving a complicit voting-machine company, foreign hackers and “communist money” was too far-fetched to justify it being filed.

Georgia election official rejects report that his office isn't cooperating with Trump probe

 

ne of Georgia’s top election officials rebuffed claims that his office is not cooperating with Fulton County prosecutors investigating former President Donald Trump’s efforts to overturn the results of last November’s election, saying his office is in active discussions with prosecutors about turning over internal documents relating to Trump’s conduct.

 

The official, Gabriel Sterling, chief operating officer for the Georgia secretary of state’s office, said in an interview with the Yahoo News “Skullduggery” podcast that lawyers from his office are “talking back and forth” with the prosecutors on a regular basis. He said he is fully prepared to testify before a grand jury about Trump’s conduct if he is subpoenaed to do so.

 

“Well, the main thing is that report is basically a load of crap,” Sterling said of a CNN report over the weekend that Fulton County District Attorney Fani Willis’s office was frustrated with the lack of cooperation by Sterling’s office. “We’ve been cooperating with the office; our attorneys are dealing with them. They literally put in a request on Tuesday for some documents. We got back to them and said, ‘OK, we can have it to you by this day.’ And in the meantime, CNN calls us and we’re like, ‘What the hell are you talking about? We’re literally talking with them.’”

 

Jeff DiSantis, a spokesperson for the Fulton County district attorney’s office, declined to comment about the dispute, saying that “at this point” his office is not providing any updates on the investigation. But the CNN report — and the response of Sterling and other officials, including Secretary of State Brad Raffensperger — has shed some new light on one of a handful of criminal and civil probes that threaten Trump’s post-presidency.

Investigators in Fulton County District Attorney Fani Willis' office have grown frustrated with the level of cooperation they are receiving from staffers in the Georgia Secretary of State's office regarding a probe into former President Donald Trump's efforts to influence the 2020 election, according to a source familiar with the criminal investigation.

 

The recent lack of cooperation has prompted the office to consider whether it rises to obstruction and to use subpoenas to force Secretary of State staff members to testify and share information, according to the source.

Ryan Germany, general counsel for Georgia Secretary of State Brad Raffensperger's office, disputed the notion that the office was not cooperating.

"I told the DA's office that we are perfectly willing to cooperate with reasonable requests regarding their investigation," Germany said in a statement to CNN. "I requested time to get an attorney lined up to represent our office to make sure those interactions are efficient and not disruptive. The DA's office told me that was fine."

Germany claimed the office was using anonymous sources to misrepresent their conversations, criticized that as "wildly unprofessional" and said it is "making me rethink whether we should cooperate with them."
