There’s Something Stirring Between Trump And Lindsey Graham That Could Go South: Ex-US Attorney

 

Former acting Solicitor General Neal Katyal appeared on MSNBC on Monday to speak about the events that have transpired since supporters of Donald Trump stormed the U.S. Capitol on January 6.

 

Katyal was asked to answer questions about Fulton County District Attorney Fani Willis hiring racketeering expert John Floyd for the investigation into whether Donald Trump and Sen. Lindsey Graham (R-SC) may have violated the law with efforts to overturn the election results in Georgia.

 

“Racketeering is often really about violent crimes like murder or kidnapping, but Georgia defines it more broadly to include false statements made to state officials,” Katyal explained.

“And here Trump does have a defense,” he continued. “What he’s going to say is ‘I wasn’t falsifying information, I genuinely believed I had won the election.’ Now ordinarily, that kind of defense wouldn’t pass the smell test, but when you’re dealing with delusion of grandeur Donald, maybe he’s got a defense there.”

 

“The investigation is not just about Trump. It’s also about Lindsey Graham, Rudy Giuliani, the former U.S. Attorney, Mr. Byung Pak and some others,” he said. “And any of those folks can flip on Trump.”

 

“And I heard you in last segment talking about Lindsey Graham, why is he still paling around with Donald Trump? Senate Big Lie Investigators To Interview Georgia U.S. Attorney Who Abruptly Quit

 

Senators investigating Trump’s attempt to overturn the results of last year’s election will next interview BJ Pak, the former U.S. Attorney for the Northern District of Georgia.

 

Committee Chairman Dick Durbin (D-IL) told reporters on Monday that his panel would interview the former federal prosecutor. His office declined to say when the interview of Pak would take place.

 

TPM first reported in January that Pak departed the Justice Department weeks before he was expected to, on Jan. 4. Pak’s departure came one day after a recording was released showing Trump bullying Georgia Gov. Brad Raffensperger (R) in an hourlong attempt to convince him to overturn Joe Biden’s victory in the state.

 

Trump officials had forced Pak to resign, the Wall Street Journal reported, for not doing “enough” to investigate the bogus claims that the election had been stolen.

Byung J. Pak, a former U.S. attorney in Atlanta, told congressional investigators on Wednesday that his abrupt resignation in January had been prompted by Justice Department officials’ warning that President Donald J. Trump intended to fire him for refusing to say that widespread voter fraud had been found in Georgia, according to a person familiar with his testimony.

 

Mr. Pak, who provided more than three hours of closed-door testimony to the Senate Judiciary Committee, stepped down with no notice on Jan. 4, saying that he had done his best “to be thoughtful and consistent, and to provide justice for my fellow citizens in a fair, effective and efficient manner.”

 

While he did not discuss Mr. Trump’s role in his decision to resign at the time, he told the Senate panel that the president had been dismayed that Mr. Pak had investigated allegations of voter fraud in Fulton County, Ga., and not found evidence to support them, according to the person familiar with the statements.

 

Mr. Pak testified that top department officials had made clear that Mr. Trump intended to fire him over his refusal to say that the results in Georgia had been undermined by voter fraud, the person said. Resigning would pre-empt a public dismissal.

 

He also described work done by state officials and the F.B.I. to vet Mr. Trump’s claims of voter fraud, and said they had not found evidence to support those allegations.

 

The Senate Judiciary Committee is examining Mr. Pak’s departure as part of its broader investigation into the final weeks of the Trump administration and the White House’s efforts to pressure the Justice Department to falsely assert that the election was corrupt. The Justice Department’s inspector general is also looking at Mr. Pak’s resignation.

Instead, the clerk who is under investigation for tampering with the county election system is Tina Peters, a fervent supporter of Donald Trump and amateur vaccine science aficionado, who appears to have executed a self-own of historic proportion.

I would note the article makes it sound like the very hole in security she was exposing could ne used to alter an election. I didn't see where she did it, and she did a valuable service exposing the hole.

 

Nothing I said indicates I agree with what she did or how. She still posted a way to hack a system rather than try to fix it, and she did not show thw hack had been used by her or anyone else. She should be taught more about posting security info and probably let go (depending on rules of her employer). She did a large disservice to her it department as the format of her id pass is now exposed.

The Florida man accused of running as a third-party candidate to siphon votes away from the Democrat in a close state senate race will testify against the man prosecutors say recruited him for the job.

 

Alex Rodriguez will take a plea next Tuesday and be a cooperating witness in the Miami-Dade State Attorney’s Office case against former Republican state senator Frank Artiles.

 

“Alex Rodriguez remains profoundly remorseful for his actions and considers his decision to enter into a plea agreement as a necessary and proper act of contrition,” Rodriguez’s attorney William Barzee wrote to NBC 6 in a text message.

 

The two are accused of keeping tens of thousands of dollars off state financial records and lying on sworn residency paperwork, felonies under Florida law with up to a five year jail sentence each. Prosecutors accuse Artiles of recruiting and paying Rodriguez around $45,000 to run as a No-Party-Affiliate in Senate District 37 last November.

 

Rodriguez shares the same last name as former state senator Jose Javier Rodriguez. Alex Rodriguez received more than 6,000 votes. Republican Ileana Garcia defeated Jose Javier Rodriguez by 32 votes.

Candidate pleads guilty in alleged Florida vote scam

 

A sham candidate for the Florida Legislature pleaded guilty Tuesday to being part of a vote siphoning scheme in last year’s election and will testify against a former Republican state senator who prosecutors say ran it.

 

Alex Rodríguez agreed to testify against former Sen. Frank Artiles after pleading guilty in Miami-Dade County to accepting illegal campaign donations and lying on campaign documents. He will receive three years probation if he cooperates, including a year of house arrest. He had faced a possible 20-year prison sentence.

 

Prosecutors charged Artiles in March with felony campaign fraud charges, saying he secretly gave more than $44,000 to Rodriguez so that he could run in the 2020 election to confuse voters and siphon ballots from then-Democratic incumbent, Sen. Jose Javier Rodríguez. The funds allegedly came from a dark money source. Artiles has pleaded not guilty.

 

Alex Rodríguez, a 55-year-old auto parts salesman with no political experience, ran as an independent in the three-way race in Miami-Dade County, pulling in 6,000 votes. The race was won by Republican Ileana García by just 32 votes. She is not implicated in the scheme.

 

“I am deeply sorry for my actions and I want to apologize to my family, my loved ones and my friends,” Alex Rodríguez tearfully told the court, according to news outlets. “I would like to publicly offer a sincere apology to the residents of Florida District Senate 37 including Sen. Jose Javier Rodríguez, the people of Miami-Dade County and the state of Florida, and anyone else who was affected by my actions.”

 

Miami-Dade State Attorney Katherine Fernández Rundle said in a statement that the guilty plea “is an important step in the effort to restore honesty to Florida’s election process, which has been tarnished too long by almost invisible, independent and write-in candidates.”

 

Artiles’ attorney, Frank Quintero, said Tuesday that his client denies doing anything illegal. He accused investigators of trying to secretly use Rodriguez as an “agent for the state” against Artiles.

A Miami Police Department investigator’s affidavit details multiple discussions about money between Artiles and Alex Rodríguez, starting with a discussion about why Rodríguez should file to run in the state Senate race.

Georgia DA Interviews Witnesses About Trump’s Call to ‘Find’ Votes

 

A local criminal investigation into then-President Donald Trump’s attempt to meddle with Georgia’s 2020 election recount is inching forward, as Fulton County investigators have interviewed elections officials and received documents from the agency, according to three people with direct knowledge of the probe.

 

“They’ve asked us for documents, they’ve talked to some of our folks, and we’ll cooperate fully,” Georgia Secretary of State Brad Raffensperger told The Daily Beast this week.

 

Fulton County District Attorney Fani Willis previously revealed to The Daily Beast that she has spun up a new anti-corruption team to explore what state laws, if any, were broken when Trump and his allies tried to overturn election results there. But her office has been quiet about the matter in the five months since.

 

Her investigators have since interviewed at least four officials at the secretary of state’s office, asking questions that show a particular interest in Raffensperger’s separate phone conversations with Trump and U.S. Senator Lindsey Graham, according to two of these sources, who spoke on the condition of anonymity.

 

According to two sources, DA investigators interviewed a number of people around May who could have been influenced by the former president’s plea to find votes, including Germany, agency communications director Ari Schaffer, chief operating officer Gabriel Sterling, and the external affairs director who oversees the agency’s outreach programs, Sam Teasley.

Threats & Leaks: New Documents Show Just How Crazy the Georgia Recount Fiasco Got

 

Back in January 2021, as then-President Donald Trump was calling on Georgia election officials to “find 11,780 votes,” new documents show that the secretary of state’s office in Georgia was in full crisis mode.

 

There were death threats promising to “make the Boston bombings look like child’s play.” Impassioned pleas for Georgia’s top elections official to stand firm in the face of pressure from Trump to break the law. And an alarmed state official demanding an immediate investigation into Donald Trump’s “solicitation to commit election fraud.”

 

In the chaotic weeks following the 2020 election, Trump was in the midst of a full-scale effort to delegitimize Georgia ballot totals, calling Georgia Secretary of State Brad Raffensperger “an enemy of the people” and sending a team of advisers to convince state legislators to decertify the results of a recount that just barely put Joe Biden ahead.

 

Emails between state elections officials show the tense moments on the first weekend of January 2021, when Trump called Raffensperger and squeezed him to “find” enough votes to tip the state in his favor—a call that was recorded and almost immediately leaked to The Washington Post.

 

The Daily Beast received nearly 700 pages of internal communications from the Georgia secretary of state’s office through a public records request. In those emails between officials and incoming messages from the public, the records show how David J. Worley—the only Democrat on the state’s election board—reached out to Raffensperger and the agency’s top lawyer, Ryan Germany, on the evening of Sunday, Jan. 3, after he had listened to the leaked audio.

 

“I commend you and Ryan Germany for sticking to the state’s position and the plain facts despite the President’s repeated attempts to pressure you into somehow changing the certified votes,” Worley wrote in an email, asking that the secretary of state “open an investigation… to determine whether violations of the provisions… which prohibit solicitation to commit election fraud have occurred.

 

Worley’s email was immediately forwarded from Raffensperger’s email account to the Washington Post reporter who broke that story, Amy Gardner, leading to a quick follow-up article.

Russian opposition politicians are used to finding spoiler candidates with identical surnames running against them in order to confuse voters at the polls. Now it appears that the impersonators are changing their faces as well.

 

That’s what Boris Vishnevsky, a senior member of the liberal Yabloko party, is facing in his district in St Petersburg before municipal elections later this month.

 

Vishnevsky already knew that two of his opponents had changed their names so that they were also called Boris Vishnevsky, an update on the common tactic of nominating a “double” to split the vote and deliver victory to another candidate.

 

But when a district voting poster was revealed on Sunday, it showed something far more shocking: three nearly indistinguishable Boris Vishnevskys, all balding, greying, and sporting matching goatees. As a Facebook friend of Vishnevsky’s pointed out, the simplest way to spot the real Vishnevsky is that he was the only one who bothered to wear a tie.

Criminal inquiry into Trump’s Georgia election interference gathers steam

 

Donald Trump is facing increasing legal scrutiny in the crucial battleground state of Georgia over his attempt to sway the 2020 election there, and that heat is now overlapping with investigations in Congress looking at the former president’s efforts to subvert American democracy.

 

A criminal investigation into Trump’s 2 January call prodding Georgia’s secretary of state, Brad Raffensperger, to “just find” him 11,780 votes to block Joe Biden’s win in the state is making headway. The Georgia district attorney running the inquiry is now also sharing information with the House committee investigating the 6 January attack on the Capitol in Washington DC.

Meanwhile, a justice department taskforce investigating threats to election officials nationwide has launched inquiries in Georgia, where election officers and workers received death threats or warnings of violence, including some after Trump singled out one official publicly for not backing his baseless fraud claims.

 

Despite these investigations, Trump is still pushing bogus fraud claims in Georgia. Trump wrote to Raffensperger in September asking him to decertify the election results, which is impossible, and with an eye on the 2022 elections is trying to oust Raffensperger, as well as the state’s governor, Brian Kemp, and other top Republicans who defied his demands to block Biden’s win.

 

Former justice department officials and voting rights advocates say Trump’s conspiratorial attacks on Georgia’s election results, and the threats to public officials, need to be investigated diligently, and prosecuted if warranted by law enforcement, to protect election integrity and public officials.

 

Experts add that Trump’s alarming refusal to accept the Georgia election outcome and seek revenge on Republican officials who ignored his baseless fraud charges may affect a few pivotal 2022 races. His efforts may also encourage extremism and restrictions on minority and other voting rights similar to ones the Georgia legislature enacted this year.

 

Veteran DoJ officials and prosecutors say the criminal inquiry launched by the Fulton county district attorney, Fani Willis, into Trump’s call to Raffensperger and other efforts Trump made to overturn the Georgia results, seems well grounded, with ample public evidence. But they said it will probably take some time before Willis decides whether to bring charges.

 

Willis has said prosecutors are scrutinizing “potential violations of Georgia law prohibiting the solicitation of election fraud, the making of false statements to state and local governmental bodies, conspiracy, racketeering, violation of oath of office and any involvement in violence or threats related to the election’s administration”.

 

The Georgia investigation’s merits were bolstered in late September by the release of a well-documented 107-page study from the Brookings Institution detailing Trump’s high-pressure drive to block Biden’s win in the state. The report concluded that Trump faced “substantial risk of possible state charges predicated on multiple crimes”.

The prosecutor, Fani Willis of Fulton County, opened her inquiry in February and her office has been consulting with the House committee, whose evidence could be of considerable value to her investigation. But her progress has been slowed in part by the delays in the panel’s fact gathering. By convening a grand jury dedicated solely to the allegations of election tampering, Ms. Willis, a Democrat, would be indicating that her own investigation is ramping up.

 

Her inquiry is seen by legal experts as potentially perilous for the former president, given the myriad interactions he and his allies had with Georgia officials, most notably Mr. Trump’s January call to Secretary of State Brad Raffensperger, urging him to “find 11,780 votes” — enough to reverse the state’s election result.
