Florida law allows him to be tried as an adult (he is 17) but the law does not allow the execution of minors, or people who were minors at the time of the crime. Yep you are correct... Supreme court case Roper vs Simmons 2005.... can't execute minors who were under the age of 18 when the murder was committed.. Dude lucked out because Roper vs Simmons over ruled Thompson v. Oklahoma from 1988 which allowed states to execute folks as young as 16. Still the court is more conservative today than in two years ago. In support of the "national consensus" position, the Court noted the increasing infrequency with which states were applying capital punishment for juvenile offenders. At the time of the decision, 20 states had the juvenile death penalty on the books, but only six states had executed prisoners for crimes committed as juveniles since 1989. Only three states had done so in the past 10 years: Oklahoma, Texas, and Virginia. Once they answer take them directly to a facility and do it. They deserve the same chance they gave Sean, NONE! A death sentence would land them on death row, which I believe would also be solitary confinement. It would then be many years, and taxpayer dollars later, when they might finally be put to death. Not very good. A life sentence would hopefully land them a bunk in general population. Where the chance of their tight young asses being sold daily for a pack of smokes is high. And, until that day when they are greeted by a pissed off murderer with a Miami Hurricane tattoo on one arm, and a Washington Redskin tattoo on the other, who gives them the same thing Jeffrey Dahmer got from his prison friend. The tragedy is, it'll be plea bargained down to 2nd degree murder, and all will be released in 5-10 yrs. One or two of them might not even do 5.
