Should the Supreme Court rule on this ? This is kind of funny.

If the Supreme Court doesn't rule on this, every state would be free to determine what " engaged in insurrection " means. Blue states could set the bar very low for Republican Presidents, and very high for Democrats. Red states could set the bar high for Republicans. Very low for Democrats. ( Remember, a charge and conviction is not required, as you said ) I think that's what this judge was referring to when he said this: Does that sound like a good idea to you ?

I think leaving each and every state the " option " to determine what the definition of " engaged in insurrection " is .. Is a terrible idea.

Yeah, I get that. But, as far as the case being made to the Supreme Court, I think it might make a difference. I think the Supreme Court overturns this.

I don't like this decisions chances of holding up with the Supremes.
