I may have stated this sentiment somewhere in the Tailgate before, but it's worth repeating after seeing this article...

It chaps my azz that Trump devotees have (somewhat successfully) "monopolized" the american flag in all its incarnations. The very people that do NOT stand for civil rights, separation of church/state, or voting rights, and who ultimately led a revolt against what this flag stands for operate under the banner of stars and stripes as though the rest of us are not american citizens and patriots. They've made it THEIR brand. That's repulsive.

I have a flag. I fly it on national holidays.  I flew it the day Joe Biden was declared the winner of the 2020 election. It looks beautiful flying by my front door.  I'll fly it the day Donald Trump is indicted or dies or loses another election.

But I understand it's only a symbol. I don't worship it or fetishize it.

Veteran NYPD officer intends to claim self-defense against charges he repeatedly beat DC Police with a metal pole

A 20-year veteran of the New York Police Department accused of assaulting police during the January 6 Capitol riot intends to claim it was self-defense when he repeatedly struck at officers with a metal pole, according to a new filing by his attorney.

In a notice of affirmative defenses filed in U.S. District Court Thursday, the attorney for Thomas Webster says an officer used “excessive force” against him while attempting to defend the U.S. Capitol Building from a pro-Trump mob.

Webster was arrested in February and indicted the following month on seven counts, including a felony count of assaulting police with a dangerous weapon that carries a maximum sentence of 10 years in prison.

Meadows’ book possible ‘waiver’ of executive privilege, Jan. 6 investigators say

Jan. 6 investigators have tried to pry information from Mark Meadows for months. Now, excerpts from his forthcoming book have piqued the select committee's interest.

In interviews, members of the committee say Meadows may have damaged his case for maintaining the secrecy of his contacts with former President Donald Trump on Jan. 6 by divulging selected details in his book, due to publish Tuesday.

“It's … very possible that by discussing the events of Jan. 6 in his book, if he does that, he's waiving any claim of privilege. So, it'd be very difficult for him to maintain ‘I can't speak about events to you, but I can speak about them in my book,’” said Rep. Adam Schiff (D-Calif.), one of the panel’s nine members.

The same logic behind equating Jan 6th with 1776 also believes the conservative Tea Party movement has something in common with the Boston Tea Party (it doesn't).  This is why having a poorly educated populous is a bad thing.  There is always going to be attempts to deceive people, but the ease it is done with these days is pretty frightening.

The "conservative" Tea Party is the old John Birch Society. Once reviled by Republicans, the John Birchers have taken over the party. The Koch brothers' father was one of the founders of the John Birch Society. It truly helps to know our country's history, including those who seek to turn it into the country of rich, white males who rule everything and everyone else can struggle to survive.

Thanks, I didn't know that. Explains a lot.

Whenever I read/hear "John Birch" it always reminds me of the Charlie Daniels song Uneasy Rider.

My point is that that was from 1962, the crazyass nutbag faction ain't new, hasn't learned any new tricks or gotten any brighter- they are the same stumbling caveman threat they always were.

People deluding themselves about them are the real threat.

Democrats used to stand up against that cohort, then they morphed into Repub-lite Hollywood $$$ vs Tx oil money WWE and forgot what their raison d'etre was.

The morlocks are exactly the same as they've always been, the same stupid mother****ers that drove us off the cliff in '29 and then screamed SOCIALIST!! at FDR. There is a direct line to be drawn from Hoover to Cheney to MTG, It's the Democratic infighting and denial that lets them get away with it. The pendulum needs to swing

'Absolute liars': Ex-D.C. Guard official says generals lied to Congress about Jan. 6

In a 36-page memo to the Capitol riot committee, Col. Earl Matthews also slams the Pentagon's inspector general for what he calls an error-ridden report.

A former D.C. National Guard official is accusing two senior Army leaders of lying to Congress and participating in a secret attempt to rewrite the history of the military's response to the Capitol riot.

In a 36-page memo, Col. Earl Matthews, who held high-level National Security Council and Pentagon roles during the Trump administration, slams the Pentagon's inspector general for what he calls an error-riddled report that protects a top Army official who argued against sending the National Guard to the Capitol on Jan. 6, delaying the insurrection response for hours.

Matthews' memo, sent to the Jan. 6 select committee this month and obtained by POLITICO, includes detailed recollections of the insurrection response as it calls two Army generals — Gen. Charles Flynn, who served as deputy chief of staff for operations on Jan. 6, and Lt. Gen. Walter Piatt, the director of Army staff — “absolute and unmitigated liars” for their characterization of the events of that day. Matthews has never publicly discussed the chaos of the Capitol siege.

On Jan. 6, Matthews was serving as the top attorney to Maj. Gen. William Walker, then commanding general of the D.C. National Guard. Matthews’ memo defends the Capitol attack response by Walker, who now serves as the House sergeant at arms, amplifying Walker's previous congressional testimony about the hourslong delay in the military’s order for the D.C. National Guard to deploy to the riot scene.

“Every leader in the D.C. Guard wanted to respond and knew they could respond to the riot at the seat of government” before they were given clearance to do so on Jan. 6, Matthews’ memo reads. Instead, he said, D.C. guard officials “set [sic] stunned watching in the Armory” during the first hours of the attack on Congress during its certification of the 2020 election results.

This illustrates how deeply-seated and strategically-placed the members of our govt/military are in regard to who wants Donald Trump to succeed in taking back something he legitimately lost and who wants a fascist in the oval office. It's terrifying and increasingly indicative of how hopeless it is becoming to combat it. Honestly, what can be done about it?

I'm losing faith in our ability to maintain a free and open election process (and so much more) because SO many of us on the inside simply have the upper hand. If our national guard (essentially our Minute Men) can't be relied upon to react at a moment's notice to something as blatantly apparent as a bum rush on the Capitol of the USA, we're f***ed in the long run. Anything goes.

I can't claim to know what the jan 6 commission has up their sleeves in the coming weeks/months to put this thing down but I haven't seen any method historically over the past 5-6 years that gives me any confidence. Half of our govt and half of our population want it and they just seem to me to be willing to play dirty enough to win. If one side can break all the rules and the other refuses to because they want the "moral high ground," it's over.

This crap is happening in stark daylight, right before our naked eyes and it just seems like there's no way to snuff it.

Roger Stone invokes Fifth Amendment in House Jan. 6 probe

Roger Stone, a longtime adviser to former President Donald Trump, is refusing to be deposed or to hand over documents to the House committee investigating the Jan. 6 Capitol riot, his attorney said in a letter dated Monday.

The letter, which Stone provided to NBC News on Tuesday, invokes his Fifth Amendment right not to testify.

“Given that the Select Committee's demand for documents is overbroad, overreaching, and far too wide-ranging to be deemed anything other than a fishing expedition, Mr. Stone has a constitutional right to decline to respond," wrote his attorney, Grant Smith. "Indeed, the Select Committee seeks an imprecise and undefined category of 'documents and communications concerning' a broad range of constitutionally protected political activity."

Last month, the panel subpoenaed Stone and other Trump allies to testify, arguing that Stone helped spearhead Trump’s crusade to overturn the 2020 election. The committee said that Stone was in Washington on Jan. 5 and 6 to "lead a march to the Capitol" and that he "promoted his attendance at the rallies and solicited support to pay for security.”

Appeals court rules against Trump in fight over Jan. 6 committee documents request

A federal appeals court ruled Thursday that former President Donald Trump cannot prevent the House Jan. 6 committee from getting hundreds of documents that were created when he was in the White House.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia ruled that although Trump retained some authority to claim executive privilege, it was not strong enough to overcome President Joe Biden's decision that Congress has a legitimate need for the material.

"The executive privilege for presidential communications is a qualified one that Mr. Trump agrees must give way when necessary to protect overriding interests. The president and the legislative branch have shown a national interest in and pressing need for the prompt disclosure of these documents," Judge Patricia Millett wrote for the court.

Trump's lawyers are likely to file an emergency appeal with the Supreme Court to block the release. The court put a 14-day hold on its own ruling to give his lawyers time to pursue an appeal.

The appeals court said Trump could not show any specific harm that he would suffer from the disclosure of the documents.

Millett closed her ruling by quoting a remark attributed to Benjamin Franklin that we have a “Republic, if [we] can keep it.”

Trump’s White House Passed Around a PowerPoint on How to End American Democracy

The House Select Committee to Investigate the Jan. 6 Attack on the Capitol on Thursday released slides from a PowerPoint calling for former President Trump to declare a national security emergency in order to delay the certification of the results of the 2020 election. The presentation, headlined was referred to in an email provided to the committee by Mark Meadows, the former White House chief of staff who’s had a rough couple of weeks, to say the least.

The revelation is the latest piece of evidence that Trump and his inner circle, including his allies in Congress, were very actively and very aggressively trying to overturn the results of the election, which Trump lost handily.

The PowerPoint presentation, which spanned 38 pages and was titled “Election fraud, Foreign Interference & Options for 6 JAN,” was part of an email sent on Jan. 5, the day before the attack on the Capitol. The email pertained to a briefing that was to be provided “on the hill.” Hugo Lowell of The Guardian tweeted slides from the presentation on Thursday detailing a conspiracy theory-laden plan for Vice President Pence to install Republican electors in states “where fraud occurred,” and for Trump to declare a national emergency and for all electronic voting to be rendered invalid, citing foreign “control” of electronic voting systems.

Apologies if this has already been posted somewhere on the board. It's one the nuttiest stories of election-reversing nuttiness I've seen and it's sickening. The video alone is alarming but the accompanying background of the story gives it context. Read the story first and then watch the video...

Trump campaign lawyer authored two memos claiming Pence could halt Biden’s victory

In one previously unreported memo, Jenna Ellis delivered a technical — and far-fetched — legal argument to another of the former president's outside lawyers.

A Donald Trump campaign lawyer wrote two legal memos in the week before the Jan. 6 Capitol attack that claimed then-Vice President Mike Pence had the authority to refuse to count presidential electors from states that delivered Joe Biden the White House.

The memos from then-Trump lawyer Jenna Ellis, which contain widely disputed legal theories about Pence’s ability to stop a Biden presidency, underscore Ellis’ promotion of extreme arguments that she promulgated amid Trump's effort to reverse the election results. Her actions have remained largely below the radar as House investigators probe Trump’s inner circle.

A Dec. 31 Ellis memo delivered to Trump’s office suggested that Pence — who was constitutionally responsible for presiding over Congress’ counting of electoral votes on Jan. 6 — should simply refuse to open envelopes from states whose election results Trump considered to be fraudulent. That memo was described by ABC reporter Jonathan Karl in his recent book “Betrayal.” POLITICO is publishing it in full for the first time.

In a second, previously unreported memo dated Jan. 5, Ellis made a more technical legal argument that she delivered to Jay Sekulow, one of Trump's outside lawyers. Sekulow represented Trump during his first impeachment and in a series of legal battles during his administration, but he had minimal involvement in Trump’s election litigation. The exception was an early November Supreme Court case regarding Pennsylvania’s mail-in ballots.

In the Jan. 5 memo, Ellis argued that key provisions of the Electoral Count Act — limiting Pence’s authority to affirm or reject certain electors — were likely unconstitutional. She concluded that Pence, while presiding over lawmakers’ counting of electors, should simply halt the process when their alphabetical proceeding reached Arizona.

Then, she said, he should declare that the state failed to meet the legal standard for certifying its own electors and “require the final ascertainment of electors to be completed before continuing.”

SELECT COMMITTEE SUBPOENAS INDIVIDUALS INVOLVED IN PLANNING JANUARY 5TH AND JANUARY 6TH RALLIES PRECEDING VIOLENT ATTACK ON THE U.S. CAPITOL

hairman Bennie G. Thompson (D-MS) today announced that the Select Committee has issued six subpoenas as a part of its investigation into the January 6th attack on the U.S. Capitol and its causes. The committee is demanding records and testimony from individuals involved in the organization and planning of rallies on January 5th and 6th, including individuals who worked directly with the former President to plan the January 6th Ellipse rally that directly proceeded the attack on the U.S. Capitol.

Chairman Thompson issued the following statement:

“The Select Committee is seeking information from individuals who were involved in or witnesses to the coordination and planning of the events leading up to the violent attack on our democracy on January 6th. Some of the witnesses we subpoenaed today apparently worked to stage the rallies on January 5th and 6th, and some appeared to have had direct communication with the former President regarding the rally at the Ellipse directly preceding the attack on the U.S. Capitol. The Select Committee expects these witnesses to join the hundreds of individuals who have already cooperated with our investigation as we work to provide the American people with answers about what happened on January 6th and ensure nothing like that day ever happens again.”

The Select Committee issued subpoenas for records and testimony from six individuals.

Robert “Bobby” Peede, Jr. and Max Miller met with the former President in his private dining room off the Oval Office on January 4th, 2021 to discuss the January 6th Ellipse rally and the speakers at the rally.

Brian Jack was the Director of Political Affairs for the former President on January 6th and reportedly reached out to several Members of Congress on behalf of the former President to ask them to speak at the Ellipse on January 6th.

Bryan Lewis obtained a permit for a rally outside the U.S. Capitol on January 6th  to “urge congress to nullify electoral votes from states that made illegal changes to voting rules during their elections.”

Ed Martin was an organizer of the Stop the Steal movement and was involved in the planning and financing the Stop the Steal protest on January 6th that directly preceded the attack on the Capitol.

Kimberly Fletcher and her organization, Moms for America, helped organize the January 5th rally at Freedom Plaza and January 6th rally at the Ellipse supporting the former President Trump’s allegations of election fraud.
