Yesterday, we brought you word that Washington Redskins owner Dan Snyder -- in his continuing effort to mount a revenge fantasy in the courts over an old article in the Washington City Paper titled "The Cranky Redskin Fan's Guide to Dan Snyder" -- had subpoenaed the Washington Post to obtain any or all communications between that piece's author, Dave McKenna, and Post sports blogger Dan Steinberg. The subpoena request included "telegrams," because it is apparently the 19th century.

For Snyder and his P.R./legal team, it's growing more and more apparent that this entire effort is aimed at intimidating the media. That's sort of an understatement, actually.

This whole matter began with Snyder's attorney warning the hedge fund that owned the City Paper's publisher, "We presume defending such litigation would not be a rational strategy for an investment firm such as yours. Indeed, the cost of litigation would presumably quickly outstrip the value of the Washington City Paper."

And only last April, Snyder's flack, Tony Wyllie actually told an "Ethics in Sports Media" panel, "Some people ask, are you firing a warning shot at other members of the media, and I'd say yes."

In other words, Snyder is mounting what is known as a strategic lawsuit against public participation (also known as a "SLAPP" suit), which is defined as "a lawsuit that is intended to censor, intimidate and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition." And Snyder's may be the most ham-handed SLAPP suit of all time, given that they keep publicly telegraphing these specific intentions, and have moved their case to the District of Columbia, a notoriously unfriendly place for SLAPP plaintiffs.

But it gets better! An attentive reader brought something to my attention that I had missed: Rep. Steve Cohen (D-Tenn), announced last week in Roll Call that he was going to draft legislation to provide anti-SLAPP protection for all Americans by federal mandate. Washington Redskins fans no doubt have been enjoying the ongoing legal battle between team owner Dan Snyder and the Washington City Paper, which published a disparaging column about Snyder and his ownership of the Redskins.

No, they published something like 79 disparaging columns full of half-truths about Snyder and his ownership of the Redskins lol...

Cohen's legislation is called the PETITION Act (which stands for "Protecting the Expression and Transmission of Ideas and Thoughts In Our Nation Act"), and it would provide a means to put an end to merit-less SLAPP suits before they become too costly for defendants by granting SLAPP victims the means to seek early dismissals, postpone discovery requests and recover costs.

And wouldn't it be ironic if Snyder's lawsuit was still deemed to hold merit even after the PETITION Act came into law lol...then what would the criticism be? I don't think this article considers that possibility.

If enacted, this law will be the first time Dan Snyder's actions achieved a positive societal outcome.

Yeah, I'm sure his charitable contributions held no positive social outcome whatsoever.

What a piece of trash we are burdened with. Using the threat of litigation to keep newspapers from criticizing the man is about as low a thing a public figure could do. If he doesn't want the press then please for every single Redskins fan in this universe please please sell the damn team and go find that rock you so wish to crawl under. Otherwise man the freak up and ignore the times when the big bad media hurts your widdle feelings. The media makes up crap about every public figure, every single one but you don't go seeing these people suing newspapers or buying media outlets to control the message like Snyder.

If Snyders only reason for all of this was to silence papers who merely criticize him, why did he wait until the WCP published 55 articles lambasting him for everything from business decisions to not tying his shoes correctly? lol...He had ample opportunity to try and "silence" McKenna in the past with the use of a lawsuit...so why didn't he issue a lawsuit before?

I can't believe how important everyone feels that they have to bring up something about Dan Snyder and his legal battles. Everyone that looks for this stuff to post wants Dan Snyder to get some sort of punsihment and hope that he sells the team. If that is your hope in life then you may want to follow another team because I don't see any of that happening. Dan Snyder has made a lot of mistakes but he has learned some important lessons about being an owner, how to build a team and who to trust his team with. But to some of you, it is like he has ruined your whole life and it is your purpose in life to make him pay. That is truly sad. I don't like what has happened to my favorite team but life happens. No one knows exactly what goes on with the day to day operations of the Redskins, not the media, not the fans, and certainly not me. I only know what the bias media spews out. If Dan Snyder doesn't grant a Washington Post reporter access or an interview then they write a bad article about Dan Snyder that may be full of lies or personal bias or both. Then, us as fans, read that article and believe what is written. But the same people that bash Dan Snyder defend his team when someone says something bad about the coaches, players, or the team as a whole. WHY? If you hate him that much then there are 31 other teams and owners to love and rout for. Pick one because this fan is tired of the uninformed fans that bash everything about the whole organization including Dan Snyder. SO GET A LIFE!

You act like you know Dan Snyder personally and can speak from personal knowledge. So tell me how long have you known Dan Snyder? What did he do to you to make you so mad at him? What if someone called you all those things without any clear knowledge but only stating things from a personal opinion? Would you just ignore it every time they wrote a bad article about you? How long do you let it go before you say enough is enough? You and everyone else make all these claims but you don't know for a fact. Articles written by the media are full of biased opinions with a little ounce of truth so they can sell papers or bring people to their websites. They control you and others like puppets on a string and tell you these things to stir up news. If you believe everything then you must believe the ESPN article John Clayton wrote saying that the Cowboys are likely to make the playoffs this year aand the Redskins are going to be most hurt by the lockout.

Really not so hard to understand. We are Redskins fans. And because of this we are stuck with Dan Snyder. If after all these years you can't understand that Daniel Snyder is simply a bad person then you just haven't been paying attetion.

But it doesn't change the fact that it sucks to root for a team owned by a guy like this.

First you say Snyder is like a "snake in the grass" using calculation and patience behind his "pouncing".

Then you go on to say Snyder acted when he did because he got his feelings hurt lol...that speaks more to it being a spontaneous decision than it does anything calculated and thought out in advance.

If every time someone wrote something negative about him and he sued them fact is he would never leave court.

Actually, according to this HP article Snyder would NOT have waited...he would have definitely sued long before now in order to nip all the negative articles early on. They claim that's why he's suing now, in fact...to allegedly scare other journalists and publications from even criticizing him lest they end up in court, too. He didn't need to wait "in the grass" 11 years to do that :ols:...

Damn skippy it will, as it should...because in the end if Snyder wins his lawsuit that means it held merit and that he was able to prove it in a court of law. Any journalist worthy of a paycheck should consider the ramifications of what they write and do a damn good job of backing up their printed statements. If Snyder wins it means McKenna didn't do that. Well, unless you want to then believe that Snyder paid off the judge and/or jury.

Can I ask you something else?...

In another thread not too long ago, you said you basically started lurking far more than posting because you felt like pretty much every time you posted here you were attacked. Your solution was to just stop posting as much which, of course, would mean you wouldn't get "attacked" if you had no posts TO attack.

But what if we kept "attacking" you anyway, regardless of whether or not you were here, whether or not you posted?...Imagine if there were a number of ES members who kept attacking you on damn near every thread they posted in. Hell, what if we somehow found other message boards you posted on even before joining ES, paraphrased your posts from those boards instead of copying and pasting them, and then started attacking you about them on here as well? lol...And of course you're lurking so it's not as if you're gonna be on here defending your past posts from other message boards, putting your words from 8 years ago in proper context for us, etc, etc...so whatever was said about you on here and was claimed to be true would just be taken at face value...with anyone who said otherwise being labeled "Addicted Apologists" lol :D...

I would imagine you would either stop lurking and post...stop lurking and leave ES altogether...or you would contact a mod and tell them that some ES members are attacking you unfairly over stuff that's not even from ES, and would ask them to put a stop to it for you...which they would.

If you did any of those three things I wouldn't blame ya. Even if I didn't like ya lol...(not saying I don't, by the way)

Get off your box. I was a fan before Dan bought the team. I am not a fan of Dan Snyder's 'Redskins'. I am a Redskins fan. If you have to question why? your head is so far in the sand that it is not worth the conversation.

Sorry don't buy it. Snyder acted like he did because he saw something that he grabbed onto that he feels he can take to court and justify his hurt feelings. It wasn't spontaneous. Your suggesting that any emotional decision is a quick little thought out choice which isn't always at all the case and further go on to defend this. Don't see too much in your opinion or reply that says your not just going to defend him here so seems pointless to continue this. I could shred your reply and expose it but really whats the point? Im not going to change your mind so why bother? I root for the Redskins and long for the day when Snyder is no longer apart of this team.

What if he doesn't lose?...What if he wins, and wins big?...A unanimous victory by the jury or a slam-dunk victory issued by the judge or arbitrator or whoever? Would your opinion of this lawsuit and why Snyder filed it change at all?

Wow the hate for Snyder on here is amazing. ( did he urinate in your wheaties or something?)

For the record, if a newspaper intimated I was committing a felony when I was not, then I would make sure they got it right. It's simply amazing how someone can hate someone so much.

As for me, I follow the Redskins, but Snyder in no shape or form affects me. I still watch the games, I still follow the team and cheer for the team and coaches. The ownership is so far down my list of priorities it's not even funny.

But I guess some people live to hate.

Your part of the problem and bring nothing to the solution. It is a statement of fact. Not in all cases but all you have to do is watch the difference in coverage of politics between the Post and the Times to see that media outlets push their own agendas. Dan Snyder deserves much of the criticism he receives but in this case he's right in principal. The WCP printed an article that had a major libelous statement. His problem is that when he sued them he's not just fighting the WCP and it's affiliates. he's fighting the entire media culture because they don't want it to become standard practice that they can get sued. Daniel Snyder gets criticized regularly by the Washington and the National media. Why is it he has never sued before? Because none of them, that I'm aware of, printed libelous statements. He may not like the criticism he receives but he takes it because there is nothing he can do about it. But when the WCP accused him of being guilty of felonious behavior he does have grounds to sue. The problem is he is fighting a 10,000 headed monster and he's already got a not very likable public personna.

So even though he's actually right in this case he is going to lose the battle of public perception because the media always has the last word and people want to believe Snyder is the devil.

just dont like it when someone says "you cant say that about him...you dont know him...but so and so is XXXX, and XXXX (someone or something they dont know)"

Why do I get the impression that the owner could offer free admission, with free refreshments for all; whilst staying on the shadows and watch Bruce and Mike put together a multiple SB winning team; and STILL there'd be those amongst the fanbase, forget those on the outside, but those amongst out own who would still refuse to accept anything the man did and continue to view him as the anti-Christ?
