Boy wants officer to go to jail for fake arrest

The 15-year-old boy who was handcuffed by a San Jose police officer for having sex with the officer's 14-year-old stepdaughter told the Mercury News on Friday that he was terrified he was going to jail. Now, he wants the veteran motorcycle policeman to feel the same fear.

"I think he should go to jail and feel how I felt, not being able to walk down my street," the boy said in his first interview since news of his fake arrest became a national topic of debate about how far a father can go to protect his daughter.

"I thought he would be a good dad by just showing up and talking to my parents rather than taking advantage of his position," the boy said.

The boy and his parents came forward Friday and asked the Mercury News to release the smartphone video that the boy's stepfather secretly shot of the officer pretending to arrest the boy in the family's home last month.

The grainy 5-minute, 36-second video shows the officer standing near the handcuffed boy and sternly telling him that it was "not a good thing that the person you had sex with is a cop's daughter" and that "the district attorney will probably file charges. ... A cop's daughter is not somebody you mess around with. You're stupid."

Now the officer is being criminally investigated for the Aug. 30 confrontation. Sources told the Mercury News that Santa Clara County prosecutors could make their decision about whether to file charges against the officer in about a week.

While the story quickly spread this week across the national talk show circuit, lawyers for both the officer and the boy's parents weighed in Friday on whether the officer was acting as a protective, concerned father trying to scare an irresponsible teen straight or an angry policeman abusing his badge. The video, which does not show the entire encounter, is not definitive on either point.

"The part that disturbs me the most is there is a man in a uniform with his hand on the gun towering over a kid and telling him that he was stupid to mess with a cop's daughter," Tony Boskovich, an attorney representing the boy's family, said. "What right does he have to use his uniform, his gun, his handcuffs if all he is is a dad?''

Terry Bowman, the lawyer representing the officer, said: "Most people can understand how this father felt and why he did what he did. It is a shame if the young man's parents lose sight of the importance of the message because they have chosen to focus on what the girl's father was wearing."

The officer was equally displeased with his stepdaughter, Bowman said, and later that evening delivered an emphatic message to her that involved a pretend trip to juvenile hall. The officer did not reach the juvenile facility, as the car ride was enough to scare his daughter straight. "Let's face it,'' Bowman said, "being a parent of teenagers is not for the weak.''

I almost started a thread on this when I saw the video a couple of weeks ago. Wanted to get people's opinion because I'm really torn on how I feel about it. On one hand the cop abused his position (and acted like a douche). He definitely shouldn't have rolled up in his uniform, gone inside the kids house, handcuffed him and berate him for 10 minutes in front of his parents. On the other hand I understand where he was coming from. But he should have just call the kids parents, met with them and let them punish their child. Like any other non-cop father would. I just don't know what his punishment should be. I think locking him up for it is ridiculous though.

What would you suggest he do to a 15 year old?

Well being that we are in the US in 2010 nothing at all of course. I mean he's a child for crying out loud... you could scare the poor kid or stunt this emotional growth!

Personally I side with the officer/dad 100%. Did he abuse his authority? Sure, and I couldn't care less. No one got hurt and a punk that was banging his daughter got the scare of his life. Seems acceptable to me. In a less ridiculous world that little **** would run and hide at the sight of her father for fear of catching a beating.

Not disagreeing....just wondering. It is 2010.....there is nothing you can do.

Aside from trying to keep his 14-year old step-daughters knees together.

If nothing happens to the cop, then nothing should happen to the dad who went on the bus sticking up for his daughter who was being harassed.

He did overstep his bounds, should have talked to him out of uniform.

btw - how about im disapointed in you, you are really to young to do this, but if your gonning to make the choice to have sex be safe and use a condom. Show them videos of STD's, pregnancy and such. Saying your going to jail/juvy is absurd.

WTF? A 15-year-old has sex with a 14-year-old and he's a "punk" and a "little ****"? You didn't want to have sex when you were 15?

Sure, I can understand the stepdad not being happy with it, but it's not like a 23-year-old had sex with his stepdaughter.

Why would he be in trouble? She's just at much at fault in this as him. It's not like he's 17-18 and she's 14...for all you know he might be a couple months older than her. Maybe it was her idea to have sex and he was an unwitting pawn! (lol)

That being said, I realize why he reacted like this as a father, but he really did abuse his authority. A reprimand is order, but that's about it.

What does what I did at 15 have to do with anything? What we're able to get away with as kids and what fathers think of teenagers banging their daughters are two entirely different things. Not every situation is has an absolute right and wrong. Some just have conflicting interests. A father is going to chase away punk kids he finds trying to bang out his daughter. A teenager is going to try to bang out some chick while her dad is at work. That's the way it's been since basically the dawn of time, only these days the father is expected to... I'm not sure what he's expected to do now, blame himself and have a good healthy cry?
