Old Dominion Monarch 06 Posted April 29, 2009 Share Posted April 29, 2009 so I was working at this company for about a month until I realized that it was a total scam and put my 2 weeks in. my last day of work was on a friday which also happened to be payday. I open my paycheck and to my surprise it was for over 10x the amount it should have been... they had me having worked a whole lot of hours that I didn't actually work. Now, I did what most people struggling for money would do in that situation: immediately put in the bank. I was told by a co-worker that given the state of this scam company that there's no way they'd find out especially since it's not like the check was written wrong, the check was written for a certain amount of hours that were listed on the stub. now, it cleared into the bank the following monday and since then I've gotten my last paycheck from them in the mail. I'm curious as to what the possible reprocussions to cashing that check could be? I haven't spent any of it nor do I plan to until I know I'm completely in the clear with it. does anyone know would could possibly become of this if they do happen to catch the error down the road? I'm thinking the absolute worse that can happen is that they can ask for it back and if i refuse to give it back then I'm thinking I could be in some trouble. If Anyone with any sort of experience in this kind of thing, or knows anyone that has gone through a similar situation could give me any advice I'd appreciate it. I'm currently planning a career in the armed forces and I'd hate for this to come back to haunt me while I'm doing that and potentially ruin that. It's on a public messageboard and someone could trace the IP back to you and figure out what you did. They definately could demand it back and sue you if you refuse. While I'm sure it's incredibly tempting to keep the money, it's really not worth the danger. I'm sure you can find ways to justify it in your mind but you could really get burned. Reminds me of this quick story - Years ago I was working for a restaurant and I messed up a programing that resulted in servers having DOUBLE the tips. So the reports were all wrong and managers were collecting less money from the servers that they should. 14 servers cashed out and walked with a extra $25 to $150 dollars. The manager realized something was wrong by then (Since all the servers were talking about how much they made). He then called me and started doing hand calculations. the 15th server got mad and said "All the other servers got free money. I should get it as well!" We figured this out the same day and by the next day each server was told how much they were over paid and were given three options "Pay it all back right away, pay it back over the next 30 days, or have it deducted from your next 4 paychecks". You would have thought I killed their Dog. They had extra money for less then 24 hours and each one of them was acting as if we were ripping them off my giving them 4 weeks to pay up to $150 back! dockeryfan Posted April 29, 2009 Share Posted April 29, 2009 This whole post sounds like a scam. But I'm not sure you have any liability here. It's a check made out in your name. It isn't like you falsified time sheets or anything. You cashed a check made out to you. If they want the money after the fact, they may try to prove it was paid in error. I don't necessarily "intend" to keep it because like I said if they ask for it back I have no problems handing it over. I was more or less just testing the water to see if I could get in any legal scoff over this right off the bat or if that part comes if I DON'T pay it back. I hadn't opened it until I was at home having already left for the day. I pretty much had to put it in the bank regardless because it was my paycheck and I needed access to some of the money for bills and whatnot. Did you participate or have knowledge of a crime being commited? Did you benefit from a crime being committed? These are the questions that you need to be asking yourself. When the **** hits the fan the police will probably come looking for you to see just what your involvement was and how much you knew. I would not be worrying about sending a letter to the company at this point. Seems like your interest would best be served by sending a letter to the proper authorities. This is my understanding of the company, without going into great detail about the "services" they provide, but I've been told that the practice is illegal in the state that I live in and the only reason they haven't been shut down is because the the business license used to run the company was obtained in another state. Now I don't know how much truth there is in that, but I do know that the "services" provided by the company are a scam. On the sales side the customer is guaranteed a certain service but when it comes down to it it's ultimately not up to the company whether or not the ultimate goal is reached because the company is essentially the middle man between the customer and another party. addicted Posted April 29, 2009 Share Posted April 29, 2009 Reminds me of a time I was working overseas for this IT company. One week everyone got huge checks. I received a direct deposit of 20k on top of my normal pay. The company since so many people had been over paid sent out a notice that everyone had 2 weeks to repay the money or else face legal issues. Some of the employees said screw paying the company back and were threatened to be fired and sued before finally paying it back. It was really tempting to try and keep the money but it's just not worth it in the long run. You have two choices...pay it back now or hold it until they notice. I guarentee they will notice sometime. BTW ~ You're not asking for our opinion here, you're asking for our approval. It's up to you, to choose what consequences you can live with. Right. You need to contact the HR department via certified letter and possibly contact the attorney general of your state if they do not respond back with arrangements in a timely manner.
