Henry, 30, of Frostproof, Fla., is scheduled to appear Thursday for a change of plea hearing before U.S. District Judge Richard Cebull in Billings. Two counts of cocaine distribution would be dropped under the plea deal filed Tuesday. The remaining charge carries a mandatory 10 years to life in prison, a $4 million fine and five years of supervised release. Henry and co-defendant James Mack, 29, of Bow Mar, Colo., were arrested in Denver in October, after authorities in Montana found six pounds of marijuana and about 6.6 pounds of cocaine that the pair allegedly supplied. (j/k) I doubt that he would have gotten less if he had been on an active NFL roster. I'm just glad that he got a stiff sentence. It's not uncommon at all. had a gang member I dealt w/ who got 15 yrs for transporting about 5 lbs of meth to Montana. No weapons, only the one charge. I believe that Henry did have priors, as well as the gang member I'm referencing. a Federal charge of unlawful weapons possession(and it doesn't have to be stolen) is a mandatory 5 yr sentence. If I'm not mistaken, a trafficking charge is federal regardless. Also, meth laws are much stiffer than laws for powder cocaine (crack cocaine laws are stiffer, too). That's what makes this such a crazy sentence. 15 years for 5 lbs of meth is bad, for sure, but it's not as relatively harsh given the laws on the books, especially when you compare the street values. 5 pounds of meth is worth about twice as much on the street as 6.6 pounds of coke. In addition, your statement regarding the gun charge further illustrates how harsh this penalty is. 5 years is the minimum for a gun charge. I'm not exactly sure what the minimum is for a trafficking charge of that size, but I'm pretty sure it's 3 years. He's getting the book throw at him pretty damn hard. CM916 Posted April 19, 2009 Share Posted April 19, 2009 You should know when entering the drug business that the penalties are ridiculously harsh if you do something stupid (asside from selling drugs) and get caught. When you have a $25 million contract to play a game, you are even more of an idiot for trying to sell drugs. Perhaps he was helping a less fortunate friend or something but he should have realised he had way too much to lose. I don't like the law but it's on the books and doesn't provide many loopholes.
