I got an eviction notice. How much time do I have ?

First, I'm not trying to get sympathy or attention - just answers - as I hate having to post something embarrassing and humiliating like this.

I hit rock bottom. Have never even come close to being evicted in my life, because I've always been financially responsible. But now, things are out of my control.

I've been out of work for a while. I have a good job prospect, but their background check could take another month or more. Applied for unemployment a month ago, but havn't seen a cent of it. Unemployment is so high right now, that they're backed up weeks and weeks, processing it and mine is still under review.

I applied for help from the County at the Social Services Dept, but I was denied, because I do not have less than $100 in my bank account (I'm close). They would only pay for half my rent anyway, IF I qualified, BUT you have to be literally down to your last penny, to get help from them. I'm pretty darn close to that, but not quite.

I'm still getting medical treatment, but I have no insurance, so all the cash I have on hand, is going to doctor visits, and other necessities.

As a result I couldn't pay November rent. So today I got the eviction notice.

It says I have a right to a trial, but in order to do so, I have to do 5 things. One of those conditions involves paying my rent to Clerk of the Court, rather than the complex. But if I had the money to pay the Court, I would have already paid the complex, and wouldn't be in this situation.

So, it looks like I just have to let this eviction take it's course.

The notice says that if I fail to meet the 5 conditions, and do so within FIVE DAYS, then I "may be evicted without a hearing or further notice".

That "without further notice part" scares me. I thought evictions take basically 30 days. But it sounds like, if I don't contest it by meeting those conditions (which I cannot do), then they could kick me out at any time.

Don't they serve ANOTHER notice giving you so many days to physically move out before the Sheriff comes and changes your lock and forces you out ? Will I have some idea when my last day living here legally will be, so I can prepare to get myself out, in time ?

And what happens when they finally evict me - if I'm not home, and they change the locks, do I just make arrangements to come back and get my stuff ?

Also, if my lease ends the end of this month, and it still hasn't been resolved, are they allowed to evict me sooner, since I will not have any current lease agreement in place in December ?

So, because of the fact that I've always been financially responsible, I don't have the experience to know what to expect from an eviction.

Damn, Mick, that's rough. Do you have a place to stay? Take care of your stuff. You don't want it piled on the curbside.

I hope you get things worked out. You should definitely do that cruise ship gig. That sounds like a good thing for you now, considering you're going through this.

here in tn you get 30 days from the due date..... then court and then ........ about 2 weeks......

get your valubles somewhere else or they will end up on the curb and anyone can take them

This is a fact.

That is what i had to do before to the person i evicted. She never showed up at court and left the state and wanted me to put all of her suff in storage for her. Needless to say that did not happen.

Wow, that sucks Mick. I don't think anyone here can tell you specifically how an eviction will play out in your case as the laws vary from one state to the next. I'm not sure but that may also be true for certain cities within a state as well.

First thing Monday morning call your state bar association to see if there's someone willing to give you some pro-bono (i.e. free) legal advice. The attorney should be able to tell you how long you have before the Sheriff shows up to evict you and if you have any options to delay it. For example in some states if you make a partial payment and the landlord accepts it that can really delay things.

In the meantime, I'd start packing and moving belongings right away because in the end even if you do manage to delay it, you're probably going to get evicted anyway and there can't be many things worse than having your stuff on the curb.

Sounds like going to sea for five months is just what the doctor ordered. Save your money and maybe by doing that you can get yourself out of debt faster than if you stayed on land.

Figure room and utilities are taken care of on board the ship, and there's probably a meal allowance,, this can be just what you need to save some money in a hurry.
