Hypothetical legal situation

Let's say I live in an apartment on a ground floor right off a street, and I have a glass sliding door that anyone can see in if the shades aren't down. And let's say I want to stand naked and watch TV or cook or something right in front of that door. Let's say I even want to pleasure myself with the shades open. Is this illegal? It seems like it would be my right to do whatever the hell I want in front of my window in my apartment, other people don't have to look in.

And this is strictly rhetorical, it came up in a conversation the other day and I was wondering if anyone had some info.

I agree with you that you should be able to beat off if you wanted to in your own house, but im not a lawyer.

I swear I've read about a real situation like this, but I just searched and I can't find it. My guess would also be that if you are in public view it would be considered indecent exposure.

yeah a guy was arrested for something similar not too long ago, but he was doing it with his door open. He was also a sex offender already. But he was arrested for it.

So I believe they will bust you for it if someone complains.

If it's a woman standing naked in front of the window, then the neighbor man is arrested as a peeping tom. If it's a man standing in front of a naked window, then he is arrested for indecent exposure :)

Seriously, I have a police scanner and this happened about two years ago in a neighboring town. Neighbor complained about the man walking back and forth naked. Cops went and busted him for indecent exposure. Not sure if the charges ever "stuck" but they did take him down to the station.

Interestingly though, while it may be indecent exposure for you to whack off in front of your open window, if someone films it they might get in trouble. Here's a related story:

SHARE Two female college students who were filmed during an intimate encounter without their knowledge are seeking justice

Massachusetts College of Art and Design students Rosanne Strott and Emily Niland were in bed together when at least two young men videotaped them from a Wentworth Institute of Technology dormitory across the alley.

The video was uploaded to a shared Wentworth student network and had been in circulation for months before Strott and Niland discovered it in April.

"When I found out, I immediately vomited," Strott said. "It was a really strange thing for me. I had never felt so violated without being touched before."

Two of the men involved in the September videotaping have been identified by Boston police as Wentworth juniors David Cunha and David Siemiesz, who've been charged. According to a police account, the two men apparently filmed the incident from their dorm room, which directly faces Strott's at Massachusetts College of Art and Design.

Cunha could not be reached for comment by ABC News or the Boston Globe, which first reported the story. But Siemiesz told the Boston Globe this week that he sensed it was wrong to film the young women.

"I felt like it was kind of wrong," Siemiesz told the Boston Globe, when asked to describe how he felt while taping the women. "We didn't understand the severity of the situation when we were taping it."

But that admission was not enough for Niland and Strott, who said they couldn't believe the degree to which their privacy was violated.

"I was just disgusted, absolutely disgusted that someone would, first of all, videotape that, and second of all, distribute it to their friends," Niland, 20, said. "It's shocking that anybody would violate my privacy like that and not have any remorse for it."

Taking It To Court

Niland and Strott, 19, said they were dealt another blow last week when the Roxbury District Court assistant clerk held off on issuing a criminal complaint against the young men until Wentworth college finishes its investigation. Wentworth would not comment on the investigation because it is ongoing but said investigators expected to finish within two to three weeks.

For Strott, a Wentworth investigation is simply not enough. "I would really like to see them expelled from Wentworth, but there should be criminal action as well," she said. "What they did was a crime."

In situations like this, you can usually correctly guess the answer to your question by using a "worst case scenario" analysis.

Think of the grossest thing a person can do to another person, then think of them doing that in front of a big open window in Times Square. The cops would get involved.

Wait a minute ... didn't the picnic table humper or the bike humper get out of the charges because he was on his own property?
Did he have an unwilling audience?

Other than furniture.

Well, in the case of the picnic table humper, the furniture was a participant, not just the audience. Here's the latest on that one:

UPDATE: Charges have been dropped against 40-year-old Art Price, Jr., but he's not yet in the clear, police say.

Price was facing public indecency charges. The case has been turned over to the Huron County prosecutor. That office will conduct a full investigation and present the case before a grand jury.

Specific charges will depend on whether the school was in session at the time.

BELLEVUE -- Police say a man in Bellevue was caught on tape having sex with a picnic table.

Bellevue Police Captain Matt Johnson says Art Price, Jr., 40, was seen on four occasions between the hours of 10:30 a.m. and noon having sex with his picnic table. What makes this a felony, Johnson says, is that it took place in close proximity to a school, which made it likely that children could have seen Price.

The neighbor -- who wishes to remain anonymous -- saw Price walk out onto his deck, stand a round metal table on its side and use the hole for the umbrella to have sex.
