The deponent is not in the Miami-Dade system, so he is probably not one of the victims if Sharpstein was correct that all of the victims have been arrested, convicted, are or should be in jail. bbuzz1962 Posted May 3, 2006 Share Posted May 3, 2006 What makes me sick, is this should fall under the fair and speedy trial statute. Since the state has boggled this case so badly, it should be dismissed on those grounds alone. For a prosecutor to resign from a case, and have the DA's office backpeddling to cover it's ass, this should be thrown out soon. I think this is a case of pure stubborness of a DA's office who knows they have screwed the pooch, and are afraid to admit it. It's over, any chance this will make it to a trial is null and void. If it does, there are so many reasons for an appeal, the DA will have no choice but to drop the charges to a much less of a charge, say a misdeameanor. Sean Taylor can thank his lucky stars that they did screw up. Had they had their act together, he was in for some serious trouble if he was convicted. He will not, you can bank on that. Anything is possible, but considering the defense withdrew a motion to dismiss in order for the prosecutor and new judge to get up to speed (or so they say), I doubt they drop a motion to dismiss on the court. Besides, even if they do drop that motion to dismiss, the prosecutor will be given time to respond. So unless the prosecutor drops the charges the case will not go away.
