Tom Brady's four-game suspension reinstated

The U.S. Court of Appeals handed down a decision on Monday morning that will reinstate the suspension of New England Patriots quarterback Tom Brady for his connection to deflated footballs used in the AFC Championship Game back in 2015.

Brady's four-game suspension was nullified by U.S. District Judge Richard Berman back in September, just a week before the Patriots' first game.

NFL Commissioner Roger Goodell talked about the personal importance of this appeal during his annual address at the Super Bowl back in February. His comments seemed to foreshadow Monday's ruling, which puts New England in a difficult position as they approach the NFL Draft. The team already lost a first-round pick due to the deflated football incident.

The Patriots open the season against the Cardinals, Dolphins, Texans, and the Bills.

"This is not an individual player issue, this is about the rights that we negotiated in our collective bargaining agreement," Goodell said at the time. "We think they're very clear. We think they're important to the league going forward and we disagree with the district judge decision. We are appealing that -- which is part of the legal process -- I am not focused on that right now.

In a 33-page decision, the second circuit court's decision can be boiled down to the following statement:

"We hold that the commissioner properly exercised his broad discretion under the collective bargaining agreement and that his procedural rulings were properly grounded in that agreement and did not deprive Brady of fundamental fairness. Accordingly, we reverse the judgement of the district court and remand with instructions to confirm the award.

It's the gift that keeps on giving. 

 

Skins fans know how much power Goodell wields & the punishment he can dole out to a team. This suspension & loss of draft picks still pales in comparison to the hatchet job he did on the Skins salary cap.

Can Brady appeal this suspension though? Or is this one (unlike last time) actually final?

 

He can, but his options are getting very limited.

 

Brady can ask for the full court of appeals to hear this (instead of just the 3-man panel that heard this one). That isn't very likely, and even if they did, I don't think they have much of a record of going against what the panel has already ruled.

 

Or, he can ask the U.S. Supreme Court to hear it. That is even less likely, as they have heard a case like this already.

 

His best option is to call Goodell, have a face-to-face chat with him, and accept some sort of punishment.

Personally, I believe if he appeals and doesn't win,  that's it, it's 4 games.  This suspension should not be reduced in any way.

 

The NFL has labelled it cheating.  Therefore cheating is cheating.  There's no level of cheating.  If the NFL believes it gained a competitive advantage, then that's cheating.

 

To reduce this suspension would only open up a can of worms for the next cheater.

My understanding is that this ruling had nothing to do with deflating or cheating but was about Goddells' power to hand out punishment as he sees fit (paraphrasing) and that is the power the CBA gives him.  This court didn't care about the scandal and just said "Yup the CBA says he can do this.  Don't like it, negotiate better next CBA time."

On a more serious hahaha note, I hope Brady does appeal this. And that the appeal is heard in late November with the ruling handed out in mid January and we are playing the Patriots in the Superbowl who start Jimmy Garoppolo. That would be awesome other wise who cares about this

You are correct, it wasn't an indictment or conviction of Brady, only that Goodell was within his power to suspend

This whole thing is just dumb. Let the man play. The NFL completely dropped the ball in multiple ways and most importantly, nobody cares if the balls were a little under inflated in cold ass weather.

My defense for Brady would be... it was during the year they beat Seattle in the SB. He did very well in catching up to beat them. I hate the Seahawks more than any team in the league.

 

Not guilty... suspension removed.

 

Edit: Of course he would have beaten the Ravens and Colts anyways without any of the stupid deflating silliness.

Everyone's focused on the issue of deflated balls and whether the owners like the pats, whether brady actually did anything wrong, the ideal gas law, etc.

 

To me the real issue is:

The NFL PA is incompetent on a level that makes Vinny Ceratto look like a shrewd GM. That has to be the worst labor union, run by the biggest bunch of idiots, in our country.

 

They GAVE Goodell this power. And that's why Brady lost his case.

 

Why?

 

Because all they cared about was increasing their share a little bit and stopping an 18 game season. They probably didn't even read the rest of the CBA.

 

Idiots. The national outrage needs to turn into laughing at the NFL PA for being a joke.

I'm surprised, but I really don't care. Brady got punished and now is suffering the consequences of tampering (or whatever they're calling it) just like every other guy in the game who does something to underhandedly swing the game in their favor.

 

Whatever, Brady is suspended, doesn't affect the Skins so I don't really care.

 

The NFL PA is incompetent on a level that makes Vinny Ceratto look like a shrewd GM. That has to be the worst labor union, run by the biggest bunch of idiots, in our country...Idiots. The national outrage needs to turn into laughing at the NFL PA for being a joke.

Exactly what we all kept saying when they hit the Skins with a penalty after they'd okayed the contracts, ONLY because the NFLPA okayed the penalty because they'd make a few extra bucks immediately and sacrifice their souls in the future. Done.

 

Asked to comment, Tom Brady said the ruling left him feeling deflated.

I sense a nasty labor fight coming for the next CBA. This court ruling is a disaster for the players. Everyone can gloat about how Brady is now suspended, but the losers in this are all the players.

 

I wouldn't bet on it.

 

The players are incapable of putting up any real fight, which is why they get pushed around more than any other league. The owners know that, and the owners know that they can stop football and start it whenever they want and get their money; the players are all on a very short clock. The owners have billions to work with and are under no immediate financial stress, while it seems like the players are footing the bill for their entire family and anyone they grew up with.

 

Not to mention the owners are actual business people and the PA reps are former players with no business experience. The owners run circles around them financially, in terms of negotiating ability and experience, and leverage in the situation.

Not to mention the career span in the NFL is so much shorter than the other major sports leagues, such that if you go on strike for more than a year, for a lot of guys that's 15-33% (depending on your data source for average career length) of your entire career earnings that you're foregoing just to get a marginal increase to the profit-sharing pie (say, a 1-2% bump in revenue allocation to the players) or better non-financial terms.

 

It would be similar to a guy making $100K per year as an accountant going on strike for 15-20 years (foregoing $1.5-2M in salary) in order to get a pay bump of $5-10K or non-financial compensation like paternity leave.

ESPN is reporting that Brady has filed a petition to have his case reheard by the same court that just ruled against him in a 2-1 decision.

 

I guess this means he wants the whole court (15 judges, I believe?) to hear it.

 

Analysts are saying that it is unlikely that they will.

 

Brady, I guess, just wants to ride this thing all the way down.

Yeah, I don't know what the NFL PA's bylaws or whatever are and how much they owe to current/former players only vs what is in the best interest of the NFL PA (and its future members) over the long haul.

 

The owners have the upper hand all the way around.

This is getting very close to the whole days of thunder japanese inspection.

Brady isn't a spring chicken anymore and this suspension is a perishable item.

If he can drag this out another year or two he may get to retire with the whole thing unresolved.

Wouldn't that be a giant f.u. to Goodell from brady.
